I was at K-Mart a few days ago, I noticed a huge soda spill on the floor, it crossed my mind to slip on it and sue but my good ethic caused me to walk around and alert the store to clean it up so nobody would slip. My question to you is, if you saw a huge spill would you slip on it even though you knew it was there and sue them, would you walk around and alert the store or not?
I don't think it works like that. I don't think you can just slip, and then BAM, 5 million dollars. For starters, I think you'd have to slip badly enough to actually get HURT. Which would suck, if you ended up breaking your neck or something. Great, you get five million dollars. Now enjoy spending the rest of your life in a wheelchair, and never being able to get an erection ever again. I'm sure the 5 million dollars makes up for all that.
Secondly, there are probably security cameras. These cameras will capture video of you clearly noticing the spill, and then DELIBERATELY trying to slip in it. Once this goes to court, and K-Mart produces the security cameras, so long five million dollars.
This is america, people have gotten 10k for spilling hot coffe on themselves. Also if you saw then you could fall in a way so your neck won't get broke. As for the cameras they need to prove you saw it, which would be hard if didn't stop.
