So about 2 months ago... I ordered The Witcher: Enhanced Edition from the UK... I waited about 2 weeks for the package (which was supposed to take 6-10 days to arrive) with no word... I am in college right now, so whenever I get a package I am notified via school email and I can go pick it up at resident services...

I emailed the vendor (through Amazon where I purchased it) and notified them that I hadn't recieved it... They told me that it was probably lost in transit because of all the Postal Strikes going on in the UK at the time... They also told me they would refund the money... 3 days later the money was back in my account... Well I was going to lock up my room mailbox down the hall nice and tight for the winter before I went home, and low and behold when I open it, there is a small package covered in Royal Mail and US Customs stickers in my box...

So could I get in trouble now that I have both the game and my refund?

Not sure exactly about the legality but you know the right thing to do. Okay just in case you don't, you need to fess up and pay the money back or send the game back. :)

That is a moral choice right there - and no one can tell you how to make that moral decision. The company obviously believes the item was 'lost' in transit - but you now have a choice in front of you. Do you contact them and offer to send them payment since the item arrived? Do you send it back to them (return to sender)? Or do you keep it? No one can tell you what to choose. As for legal consequences - you'd probably have to talk to someone who knows a bit about law, but I am guessing it would a) depend on the person on the other end, and b) be a fairly minor misdemeanor type charge if anything at all.

There is always a chance you could get in trouble - if the seller finds out you did receive it, yet they sent you a refund.

Since you seem worried about it, I assume you know that the right thing to do would be to send a message to the seller and let them know that the package did arrive. You should offer to send the money back. Most likely, they will not accept the money back, since the package was probably insured and they got their money back.

Just an idea.

Despite ordering it from overseas and getting express shipping it was still almost $20 cheaper than in the US, so I guess I owe them that much :(

There is nothing illegal about it. You purchased an item from a provider, it didn't turn up, they said it was probably lost in transit, if they were smart they would have collected the insurance on the item that was sent. The question is 1 of conscience. Personally I'd let them know the item turned up later, and ask how the would like me to pay for it _but_ that is completely up to you.

But seriously; I'd just keep it and sleep tight knowing they're probably better off than myself; and they will most likely collect on the insurance.

Techically it was not illigal, it was some strange curcumstances that let to that outcome. Usually you can see exactly where a package is on its route, and it likely did get lost around halfway there...

That it showed up atlast was a good thing, but not giving your money back would have been pretty bad. I am somewhat certain that they got such things covered in any case (considering how many packages gets lost every year).

The right thing would ofcourse be to send thier money back, but at a legal standpoint there is nothing at all to surgest that you acted with ill intent.

That's the real debate. If they insured the package and collected the money for it being lost, would the company turn down your willingness to pay for it now? Do you think they would contact the postal company to give back the insurance they collected? Or would they keep their mouth shut and happily collect your money, too, effectively getting payed twice for one game?

Yeah, I'm cynical when it comes to companies....

I say stick it to the man. It's usually the other way around, so you gotta take advantage of your opportunities as they come ;)

Believe me, this is not really a big deal either way. The loss from this game will just be added to an expense line on their income statement. It's probably already there, and it really won't have an impact one way or another.

The decision is pretty much irrelevant.

It happens, I work in a post office and such a thing, while it is rare, it does happen. That said the sender can find out that you've recived the package through the Post service since every package has a code so they won't be sent to another country and that you now can use to track it's location. While that is the case here in Norway, I can only assume it's similar in the UK. If I were you, I would just contact them again and tell them you finally recived the package and that you want to give back your refund so you've paid for it. You can refuse and you can get away with it but that's more risky and might hurt your pockets more then to just pay them.

What grief? Packages are delayed, and sometimes 'lost'. He shouldn't be crying his eyes out. They gave him a refund. It's standard that when you get a refund you return the product. It's not rocket science. Also, I don't know if your sarcastic.

Pay them back, while nothing may happen, something might happen. Not paying them back would be classified as fraud of course that's if they bother with any legal action or peruse the whereabouts of the package and find it did get to you. Plus it is the right thing to do, sure it arrived late but you did receive your product, perhaps they'll take a percentage off for the delay or something.

Ok I have another question, you guys keep saying they would have tracked it... I never check my mailbox here at the school (because I didn't forward my address and I still recieve my mail back at my parents' home)... For all I know it could have been sitting in that mail box since October when I ordered it... So if they were tracking it, don't you think they would know and wouldn't have offered me the refund in the first place?

Because I never thought to look in there because all of my other packages have come through Resident Services... The USPS put this package directly into my mail box...

Semi sarcastic. But I believe that when someone is late with something by several days an explanation should be provided. Personally I expect to get a package by the stated time not after. Not responding to a customer's inquiries is not very good business practice. Ignoring customers usually doesn't bode well for the company, take GM and Chrysler for example

Indeed. Tell them that you got the package, ask if they got the insurance, etc. There's a chance if they got insurance you might get it for free (because it was so late.)

Ive had so many annoying moral issues to deal with lately. Like selling a game to people that I knew wouldnt work cuz it was tied to my account. I felt like such an evil person after that. They actually contacted me about it later when they got it and to rectify the situation I offered a full refund upon receiving the game back. What happened? They never sent it back...oddly enough. I still feel sorry about it. Im usually very honest - you know the whole do unto others as you would want for yourself? - ya that. I vowed never to do such a thing again. As for the OP. Dont sweat it man. It was a misunderstanding and you came out with a little extra. Its all good.

Heh, just buy $30 worth of stamps to make up for it, since the vendor will probably file a claim... But when they make a claim, the post office is going to say... It was delivered. At which point things might get interesting. lol

The company would have already collected the postal insurance so I wouldnt worry about it. Unless you want to pay them twice.
