https://www.gamespot.com/articles/pubg-dev-suing-fortnite-studio-for-copyright-infri/1100-6459244/

Back in September, PUBG Corp. said it was "concerned that Fortnite may be replicating the experience for which PUBG is known." The Korean studio said PUBG is the "first standalone Battle Royale survival shooter game."

Let's break it down like this.

This is like EA suing Activision for COD replicating Medal Of Honor, since they were the 1st accurate WW2 shooter.

Could you imagine Square suing other rpg makers for including a sidequest?

Yeah, this is stupid. You can't own a genre and this stands a good chance of blowing up in their face.

Not really.

China gets away with copying cars, so maybe Korea has the same stance on it as well, so they will favor PUBG just because the company is Korean.

@Ant_17: Oh yeah, this is in Korea... Will read the article next time.

It's still dumb. Game mechanics evolve because other companies can pick up an idea and run with the ball, kinda like PUBG corp did.

There is another dimension to this that people ITT arent getting.

Both games used Unreal Engine 4, and if im not mistaken, PUBG Corp. worked with Epic to add their own code to the engine to get the game to run. So EPIC had insider knowlege of the inner workings of their game, then turned around, shoved their ideas into their own game, implimented them first, got it to consoles first, then made it free?

There might be a credible case of corporate espionage here.

Well, this is a game I'll refuse to support if it ever comes to the PS4.

And after this, I hope it stays away from it.

Ok, here's an article on it. It's 8 months old, and it doesn't seem to have been very widely reported, but it would be interesting to hear more on this take.

PUBG dev explains why Bluehole has an issue with Epic Games and the Fortnite Battle Royale mode

By Sherif Saed, Monday, 25 September 2017 14:39 GMT

PlayerUnknown’s Battlegrounds developer Bluehole’s concerns about Epic Games copying the game’s battle royale formula were not well explained in the press release sent on Friday.

The release made it sound like Bluehole is not happy about Fortnite’s Battle Royale mode copying major elements from PUBG, but the issue appears to be bigger than that.

Bluehole VP and executive producer Changhan Kim clarified the company’s position in an interview with PCGamer, saying that Bluehole isn’t going after other developers making their own versions of battle royale.

“So the first thing that I’d like to clarify is that this is not about the battle royale game mode itself,” said Changhan Kim.

“There were other BR game modes earlier this year that were released, like last man standing or GTA 5’s battle royale game mode, and we never raised an issue, and I think it’s great that there’s more competition and everyone should be able to create their own battle royale game mode, and it’s not about the idea itself, it’s about Epic Games, and that wasn’t really clear [in the press release].”

The issue of the copycat being Epic Games – the company that makes the engine PUBG is based on – appears to be the main point here. According to Changhan Kim, this wouldn’t be an issue if it were any other developer.

“So, battle royale is just about last man standing, it’s a simple game mode, and we’re not claiming any kind of ownership over the game mode or genre itself, it’s not for us to even comment,” he explained.

“There were a lot of copycats in China and [in that] industry there is a lot of battle royale games that look exactly [the] same as ours, so we will definitely look into similarities if there are different products that are very similar to our game, but even before we actually looked deeper into how similar [Fortnite Battle Royale] is, we wanted to raise an issue because this is from Epic Games.”

Kim pointed out that other games that used Brendan Greene’s ideas for battle royale actually had a license to do so, citing King of the Kill and PUBG itself as both following this rule. Epic Games has clearly not done this.

But there’s another issue that’s potentially at the heart of this conflict: Bluehole’s fear that Epic could be making engine improvements that benefit Fortnite which won’t be shared with the PUBG team. Seeing as the two companies are now competitions, this could be a problem.

“We’re going to get some technical support [from Epic], and we’re going to work with them to make sure Unreal Engine better supports battle royale gameplay which requires 100 people in one session, and now we’re starting to have concerns that they’re going to develop new features or improve something in the engine to support that battle royale gameplay, and then use it for their own game mode,” the executive elaborated.

The other side of this is that any improvements made by Bluehole internally to Unreal Engine 4 could leak out, benefiting other studios. Bluehole is also not happy with Fortnite using the PUBG name in promo material, with Epic developers citing PUBG as inspiration for Fortnite’s mode.

“It was in their promotional video that was posted on Twitter and they would openly mention that they were fans of PUBG, we wanted to make this battle royale game mode, and that kind of gave the impression that we were officially involved in this,” he added. “[Sic] there were players like, ‘Oh it’s cool, now we get to play PUBG in Fortnite’, and there was nothing we could do about it, because it was depicted that we were officially involved.”

Bluehole has reached out to Epic Korean, which in turn has contacted the US headquarters, but no contact was made between Epic and Bluehole directly after the press release was sent – seeing as it was the weekend.

From the article, it doesn't sound too much like corporate espionage, but then it's also not mentioned how much contact they had during development and before release, so who knows.

this couldn't have been about battle royale in the first place, the whole last man standing thing already existed since forever. Unreal tournament, which is almost 2 decades old, already had last man standing.

Guess what that game is owned by epic lol, what a fail thread.

Imagine if MS turned up to E3 with a game called Deity of Combat featuring a bearded deity and his daughter as they battle through hordes of Norse enemies.

I couldn't even see Sony suing over that!

Because I don't like their product or business practices. Their studio shutting down would hopefully force them to make better games and make their stupid actions stop. I don't want to see them continue with trying to sue other studios for very stupid reasons just because "but think of the people and their jobs! ='( ".

Never I want these two games to cannibalize themselves and disappear. No in all seriousness I don't play either so I don't really care what happens to either. PUBG did come out first with the concept so it should be a pretty easy case. Plus Fortnight was originally supposed to be just a base building and defend it game for 60 dollars and it sold like shite. Then when Fortnight does a free battle royal mode now you can't not hear about the stupid game. Genius.

Guess someone's gonna sue WOW for copying MMORPG one day.

But one thing i have in question is that are they suing Epic Games in Korea or Epic Games Corporation...because suing subsidiaries is different in liability laws (well at least in US, not sure in Korea)

While I don't agree with the hyperbolic nonsense that the devs should go out of business for this. I'd argue that there is nothing unique about PUBG to call there own other than the fact they were the first 'Big' BR game.

I think Jim Sterling says it best

So let me get this right, only marvel or DC can make super heroes but not both companies,no company should make cars because of ford,Pepsi is a great example coke did try to sue them when Pepsi was new and they loss,so no carbonate sodas with caffeine,is either hershey or MM mars..

This is incredibly stupid,so no Forza because of granturismo,no sandbox games because of GTA.

Fortnite is just popular and pubg developers can't take it.

I did laugh that COD is gonna be a Battle Royale game now too.

When am I getting my official Hunger Games game, that's what I wanna know.

@freedomfreak: Sort of mistaken. H1Z1's battle royale mode appeared before PUBG.

PlayerUnknown originally made a mod for Arma III before it became an officially licenced game mode in H1Z1 called King of the Kill. This was worked on by PlayerUnknown before he made the spiritual followup in PlayerUnknown's Battlegrounds.

@freedomfreak: No, he's not suing the developers of H1Z1, he is suing Epic (Fortnite) for using the game mode. However, the question is up in the air whether or not PlayerUnknown actually owns this gameplay type. I've played Minecraft mods that have been doing this since 2012.

He's not the originator of the idea. Only the one to popularize it so I'm not sure his lawsuit holds water. However, I do think the move is cynical on Epic's behalf, and other developers adopting this game mode is clearly to bank off a trend. Now, these could still end up being fun but it was clearly not part of the original creative vision for these games.

@freedomfreak: I mean, I guess they want to get rid of the competition as well as claim complete control over the intellectual property of the gameplay type. I think it's fairly dishonest when you consider that what is essentially a game-mode has never been something wholly owned by one particular game or developer.

@freedomfreak: Haha!

If anything, they owe their creativity to the Battle Royale novel. The whole concept, even the shrinking play-zone is lifted entirely from the 1999 novel. He made a game-mode based off a 1999 novel and is now suing anyone who copies him...

@freedomfreak: It does seem very peculiar to me. The rules that govern game modes have always been a thing adopted without question among many different games. I don't see how this is different.

The PUBG folks are just butthurt that there game is shit and they are losing players and press to a better made game from a more competent development team. No surprises there. As any talentless hack dev on Steam will tell you, if you can't win people over to your side with actual quality, bully them into submission and sell your hot garbage anyway.

My favorite part about all of this is that after PUBG became more than moderately successful (at least in recent success comparisons) EPIC dumped their (entirely too long in development) debatably garbage zombie shooter and rushed out a (only possible in such a short time because of the low quality and plug-and-play development toolkit) copy of PUBG.

My second favorite part is how EPIC went the 'free with mass micro-transaction' route, and despite offering limited items on a daily rotational basis for an exorbitant amount of money, they actually made money hand-over-fist.

My third favorite part is that EPIC then dumped Paragon to pursue this money tree.

I enjoy PUBG way more than Fortnite, even though Fortnite runs better. PUBG has come a long way on the X1 though.

Also, it’s already been pointed out that the issue isn’t about “genre ownership”.

@jumpaction: and the author of that novel got the idea from wrestling, which itself is based on a sport of the same name. It's almost like expanding on other people's ideas is a vital part of creativity.

@toast_burner: I know right? It's almost like suing someone for an idea you didn't create is a dodgy thing to do. I think it's very strange that Bluehole are pursuing this...

@jumpaction: and even if they did create it, that still wouldn't be grounds to sue. They really are a bitter bunch.
