It seems Capcom has a long history of pilfering. The data-breach helping to crystallize this. Again, seems rather blatant.

Seeking 12 Kamillion Americano dollars. Bit wishy-washy on the laws of photographs.

Clearly they have used her work if those images are accurate. But it’s 25 years old. I mean 12 million seems a tiny bit excessive 😂.

Ha, yeah it's pretty blatant. Saw the ME009 example the other day, just straight copy/paste with some scaling on height.

Not to excuse it, but this was extremely common in gens 5 and 6. Texture artists would amass their own personal libraries from any random ass sources. Plop some crusty jpeg on a UV island, call it a day lol.

Surprised we don't see cases like this all the time.

When Capcom tried to earnestly write things themselves, it resulted in Resident Evil 5 and Dragon's Dogma.

Yeah, doesn't surprise me that Capcom steal things.

$12M might seem excessive at first. But then consider that RE4 sold 10M copies, equivalent to at least some $300M (assuming $30 each). $12M isn't so excessive after all.

Shitty practice. Those are copyrighted, so she's definitely entitled to damages. Probably gonna come down to how much was used and what was noticeable, so probably a settlement in the hundred thousands range.

Likely to settle, but the plaintiff should make them bleed. Major creative studios ripping off other artists is exactly why copyright law exists.

Man this is the second time Capcom used other people's art for their Resident Evil games without their permission. I wouldn't be surprised if they did that a bunch of times.

When looking at their concept art unlocks in-game it looked pretty clear some were not drawn like many other studios do but clipped out of other digital images and ran through photoshop filters to kind of sanitize them, and I saw those thinking why does it look this way... now I get it.

I get feeling resources like this might have been to help the artists designing it try to strike a tone or style but maybe the talent replicated the material rather than reinterpret it.

Those sums are way overblown. She should be payed whatever the price of the licensing would have been (adjusted to inflation) + a percentage of the profits from the games (no more than something like 0.5%).

I'd be surprised if most of the games (especially the older ones made before Substance Painter/Designer, Quixel) don't have stolen images for textures as the devs hire third party artists for modeling and texturing all the time and these artists just go to google image search and take whatever images they need for their textures.

Yep. I can attest to this personally. Goes to a mediator, and lawyers go back and forth largely through said mediator. Typically the settlement is much less than the ask. "Shoot for the Moon" and all that.

If damages aren't high, it doesn't disincentivize companies from stealing.

With large amounts of damages sought, it actually has an impact.

Don't think of this as 12 million being given to someone, think of it as 12 million taken away from a thieving corporation.

Frankly I think the artist should seek more; Capcom and their army of lawyers will argue it down to a settlement they can actually afford.
