What backfire? You can gladly take our pirate trash, there all yours.MS let pirates run rampant all this time and then right on the release of one of the biggest games this gen, right before x-mas they ban everyone. They didn't do this for the good of the industry, they did this so ppl will have to buy more xbox's.
I'll bet you this banwave will pass, x-mas will pass and they'll let pirates go back to doing what they do and next year around this time, probably before Reach lands, they'll do this again.
They don't care about 3rd party dev's losing money on games, they barely have any first party studios, the pirating is helping them more then you guys imagine, this is all in the name of profit. They've clearly proved they can find and ban modders with relative ease.
I could be wrong, and the days of 360 modding are long gone, if that's the case I'll admit I was wrong in a couple of months, but I'm pretty damn sure they'll let pirates go back to there old ways so they can sell more consoles. Think about it, if the 360 was no longer pirateable, why not just get a PS3?

Microsoft, Sony and Nintendo charge developers royalty fees for the privilege to publish games on their console. Even if MS doesn't have any first party studios (an exageration but I'll let it slide for the sake of discussion), they make money from every third party title that's published and sells on their console. However small the royalty fees may be, profit is profit. So MS does have a vested interest in the sales of third party games on their system and it is in their best interest to ban pirates as soon as possible, even if it doesn't turn into a bunch of new console sales.
Besides, if you'd been paying attention to the news in recent months and years, you'd see that MS cracking down on piracy is not a new phenomenon in the slightest.
