I'm chatting in a gaming chatroom right now and some just posted that he saw on MTV news or MTV something about Microsoft threatening to sue sony if they do release the custom soundtrack feature that we've heard rumored to be with the 2.40 FW update.

I dont know if this is true or not, havn't really looked on the MTV site. But it wouldn't surprise me if true and it may be a reason why we havn't gotten 2.40 yet. and this is also the reason ingame XMB was not a launch feature for the ps3

How can they sue them for it. Did Microsoft invent music now? I don't see how a feature that the PSP has and I'm pretty sure the PC has had for ages, is somehow owned by them...

correct me if im wrong but since when can you patent a feature like custom soundtracks? its not really a tangible asset or piece or work, art, litrature etc.

it was never confirmed whos fault it was, its more likely to do with the fact that neither nintendo, rare or microsoft own the licence to the james bond games.

I searched on MTV.com and goodle, and I don't see anything about MS suing Sony over in game music. Like the above poster said, that doesn't even make sense.

Wow...if this escalates and judge should just tell MS to go back to counting their money. Not only would that make them realize that they have more money than god, but it would keep the occupied for the next century or so :P

They have a patent that more or less says that : accessing an application or playing music while executing another application or some similar stuff. Im sure that Sony has found the way around the patent (thats why we have lawyers :P) cause the patent is old, and they would miss this big fact. I would bet that the delays of in game XMB is due to this patent and Sony looking their way around (if you can find something different then you cant be binded by it)

If this is all really true, I'm surprised at Microsoft. Industry Standards are what they preyed upon when they came in, now they don't want to be apart of that? I hope it's all bogus.

If MS have patented a specific way in which the custom soundtrack is accessed and used then they could sue Sony if Sony infringed on their idea without paying MS money for it. Thats the whole point of a patent. Its not the concept but the way its implimented thats at issue.

That doesn't matter. Maybe sony should have had the foresight to patent it back then. Once MS was awarded a patent, anything that is done AFTER that point is relevant.

How did the PS1 store music? The memory card?

if MS could sue over this they would. MS's lawyers aren't exactly known for their laid back forgiving nature :P

I don't think a high score is specific enough to patent. Even if it were, here's what we're talking about. The high score in mario is for doing something in a single game. The gamerscore is awarded for doing things across multiple games. Same basic concept, but different execution.

I am pretty sure that it doesn't matter who did it first. It matters who got the patent first, and because it is Microsoft name on those patents they did it first so own the patent.

if it uses the same kind of coding or tech or watever, they should be able to sue, but this sounds highly unlikely.
