Never heard of Vib Ribbon, huh? It was a Playstation game where once you began playing the game, you could insert a music CD and the music would play along with the game.

But that isn't what Microsoft has patented with the Custom sound tracks patent. That's not even having a custom soundtrack. That's just inserting a CD to play while playing a game.

Why do people wish for a console maker to go away? It's fine to have 3 console makers in the market. More competition = more choices for gamers.

I don't know how M$ could sue for this, as someone else said it's a feature that's been around for ages.

I am pretty sure that it doesn't matter who did it first. It matters who got the patent first, and because it is Microsoft name on those patents they did it first so own the patent.

If you invent something and have evidence to support that claim, you can take the patent to court and get it voided. The hundred thousand or so copies of Vib Ribbon that have been sold are plenty of evidence to void Microsoft's patent. This type of evidence is a lawyer's dream.

If you invent something first but not the first to patent it, you don't have the patent to it. I read over the Patent law and there is nothing I can find about voiding the patent if someone else invented the thing first.

I am sure the people at Sony aren't dolts. they will either find a loophole, or something.

I would assume they aren't too keen on paying the competition if there is any possible way of getting out of doing so.

The CD you inserted would shape the levels of vib ribbon... you never played it, did you? I think the patent is on shakey grounds already. As you can see, the patent is very verbose, and protects many different ideas. If even one idea can be shown to be unoriginal, the entire patent can be voided and Microsoft will have to redo the patent without that provision.

Putting a CD into your disc tray and listening to the CD is completely different then the Patent Microsoft has created as I've said.

Once again it doesn't matter what you think.

Sticking a CD into a disc tray and listening to it while playing a game isn't the same as copying, and creating a playlist on your consoles hardrive to be able to listen to at anytime and point during a game via access to the HDD or other storage area.

Oh and here is theCustom Sound Track Patent posted by someone else I believe. Its completely different then the game you speak of where you put an actual CD in. That wouldn't be a custom soundtrack anyways. That would just be listening to a CD in while playing.

Sony should just have a music button under options like with MLB 08 so they do not have to bother with the patent. Why the hell would MS patent this and cross-game invites...so annoying..so annoying..

If what you say is indeed a fact you would have no problem finding any evidence or proof to back it up thus stopping anyone from ever disputing them. But see you don't ever do this.

This is no different then you claiming Star Ocean 4 going to the PS3 is fact. Its not because you can't prove it. You throw your opinion around way too much here.

Hell you wouldn't even bring forth factually evidence on Metal Gear Solid 3, you're just going by your own thoughts. Bottom line if you can't prove it then it has no merit.

I don't understand why you don't want to/refuse to try and back your claims.

The US patent named "Method and Apparatus for Creating and Playing Soundtracks in a Gaming System" appears to cover any application that allows users to create soundtracks using their own audio tracks, such that they can be played during the execution of the game instead of the game's default soundtrack.

Comprising of a thorough list of points and diagrams, the patents stand out claim is outlined thus:

1. A method comprising:

- receiving a request to launch a game in a gaming system;
determining whether the game has a user-associated soundtrack;
- if the game has a user-associated soundtrack:
launching the game; and
playing the user-associated soundtrack;

- if the game does not have a user-associated soundtrack:
allowing a user of the gaming system to select a soundtrack to play while the game is executed; and
playing a default soundtrack if the user of the gaming system does not select a soundtrack.

What does this mean for Microsoft's competitors? Will this patent stop Sony from implementing the console-wide custom soundtrack functionality? This is possible, and could be the reason why it has been missing from the Playstaiton 3 for so long.

Sony may have already found a loophole in the patent to allow them to provide custom soundtracks for particular games, as long as the functionality is not system-wide. In this way they could avoid the patent. Microsoft could charge Sony for the privilege, but it would be a lot of wasted effort to patent this particular feature and then allow competitors to implement it.

Therefore, when Sony's in-game XMB eventually comes around, custom soundtracks might be left on the cutting room floor. It will all depend on how constricting the patent actually is, and how kind Microsoft are feeling. Reasons for the in-game XMB delay may be found here - Sony are trying their best to get custom soundtracks installed legally.

Im curious if most of you even know what a patent is... the majority seem to think that a patent is the bare bones concept of something. To make this as easy to understand, there isn't a patent for creating custom soundtracks, there is a patent for how custom soundtracks are implemented into video games.gamer620

If what you say is indeed a fact you would have no problem finding any evidence or proof to back it up thus stopping anyone from ever disputing them. But see you don't ever do this.

This is no different then you claiming Star Ocean 4 going to the PS3 is fact. Its not because you can't prove it. You throw your opinion around way too much here.

Hell you wouldn't even bring forth factually evidence on Metal Gear Solid 3, you're just going by your own thoughts. Bottom line if you can't prove it then it has no merit.

I don't understand why you don't want to/refuse to try and back your claims.
