Microsoft is banning Xbox Live accounts for what it describes as "Marketplace Theft".

Xbox 360 owners, many of whom have pleaded innocence, have reported receiving permanent bans from the online gaming service up to 12/31/9999.

In a thread on the Xbox.com forum titled "Suspended for Marketplace Theft?", a spokesperson for Microsoft explained that the action was in response to those who had "illegitimately" accessed downloadable content.

"During the course of a recent investigation, we have discovered users who illegitimately accessed Xbox Live Marketplace downloadable content," the spokesperson said.

"Our investigation reveals that this access was intentional and not accidental, constituting a blatant violation of the Terms of Use for the service. We will not divulge additional information regarding individual suspensions for these offences.

"Please know that we are being very careful regarding these suspensions, and have clear evidence regarding each account issued a permanent suspension from the service. We apologize for any frustration or confusion resulting from our inability to share individual details, and thank you all for your cooperation in this matter."

Just a tip you wont be banned that I know of for downloading something microsoft put up early or for free.
You will be banned under these circumstances for spoofing the system, spoofing Microsoft codes for direct downloads of material...etc

but you wont get banned for stuff like that, it was an accident that was sourced in microsoft you wont be banned for something like that. you will be banned if you spoof the system, or spoof codes so as to directly download material.

I think this is what is happening they are tlaking about a hacked 360 gives points to another legit 360, the legit 360s are now being kicked.

Please forgive my ignorance, but what exactly is spoofing the system? I understand that it means tricking it, but as far as Xbox Live is concerned, what is happening?

Which the other services do not seem to need.

Don't know how you can make the statement when there are many I've seen on ps3 that should be banned from ps3 and yet...aren't touched even after I report them not like it would matter they'd just make a new account for free and get right back on.

Really? I knew you would reply at the speed of light to that. :P I don't have any bad experience with PSN players and I never really hear people complain about the PSN situation. I did hear a lot of talk about the amount of racism etc. on Live, but I am guessing that paying for such a service makes people a little more prone to complain.

And of course I play on the European servers, so maybe it's completely different in the USA.

IP spoofing, wait time spoofing. say you get on and wait time it a developers bit of content is put up and usually the consumer 360's OS sends a signal and is confirmed as not allowed to access but if you wait time it your able to access the bit of content before access its denied and since downloads wont usually be broken when they are successfully started... spoofing the code system using a code generator that allows you to get a direct code for content download.

No game is hacked on the ps3 no game has users using glitches, hacks, or known vulnrabilities in games...which would be what I was referring to when it came to users that should be banned.

I'm always amazed that people try that kind of stuff. I guess it's really cool to try and see whether it works? At the package centre there would be a theft every few days. And what do they steal? Mobiles. Not even mobiles really. In most cases, a mobile. You can get like 20 euro for them if you're lucky. They all get caught and they all know they get caught cause there were more camera's in that building than employees, and they still did it. They had a job, a roof, everything. And they still did it. I just don't get that.

I understand that. But all that to save $10 or &15? And now they're perma-banned. Crappy trade off if you ask me. I'm sure it's not as much about the money as it is about being rebellious and sticking it to "the man."

Gotta remember they have ways of getting around bannings, heck 200 dollars or less for a 360, changing aspects of the hard drive so it can be used on another 360 sell that banned 360..etc the majority of the time a ban wont be bypasses by most users they'll get a new 360 and account, get a new 360, get a new account...you have 2 levels of ban system bans and account bans so...the truely devoted thiefs and such go around things.

MS should do what Bungie did a while back.

A mod/dev went into a forum thread of people whining about getting suspended for and exploit where they pull their ethernet cord just before completing a challenge, then doing it over and over again to collect on the same challenge multiple times. Of course, all of them were pure as the driven snow and claimed innocense. The mode/dev offered to address each case and, if the claims checked out, he would reinstate their accounts and credits. Of course people responded. He got back to each of them with server logs clearly showing their guilt.

So he offered them a double or nothing offer. Post to claim innocence and if ok, would get double the credits. If not, they got double the suspension time.

No one took him up on the offer.

Main problem with these console "services" is there's no credible appeals process and I don't trust their ability to "investigate" anything either.

If your account gets hacked or phished, and you get banned, your account which may have tens of thousands of dollars worth of content suddenly becomes worthless, and your appeals process is at the mercy of people who really have no incentive to help you and every incentive not to. Either way it will take weeks or months before you either get your account restored, or get told to piss off.

If your account gets hacked or phished, and you get banned, your account which may have tens of thousands of dollars worth of content suddenly becomes worthless, and your appeals process is at the mercy of people who really have no incentive to help you and every incentive not to. Either way it will take weeks or months before you either get your account restored, or get told to piss off.

the same would be said of any other service on pc or other. If you got hacked then least to say that was your fault its not hard to have a good password on every thing you use, and frankly on xbox live the only way to get your self hacked is by having woefully bad passwords on your account connected to your xbox live user name, or putting up so much informaiton people can easily do a password reset on your account.

As well Microsoft will know if you've been hacked..they investigate it and they will return your account too you even if it has been suspended, but only if its truely been hacked.

And the reason I don't have a seperate account for my brother and myself is because of the fact you get charged per account, ridiculious.

"Ok i'll make a new account!". It's as simple as that on PSN i got someone banned and saw him a few weeks later with the same name but a 2 at the end. If you got hacked then least to say that was your fault its not hard to have a good password on every thing you use, and frankly on xbox live the only way to get your self hacked is by having woefully bad passwords on your account connected to your xbox live user name, or putting up so much informaiton people can easily do a password reset on your account.

As well Microsoft will know if you've been hacked..they investigate it and they will return your account too you even if it has been suspended, but only if its truely been hacked.

Yes, as I said, if you get hacked or phished, you are at the mercy of people like you whose first inclination is to blame the victim and say "Well it couldn't have possibly been us that got hacked, so you must have used a weak password like '12345', please stand by for 3 months while we investigate and tell you to piss off."

And yes it can happen on any service in this bright, wonderful DRM age of ours where everybody's rights are considered except the people who actually do the buying.

I actually prefer a system whereby people can just create an alt account.

I don't trust having some big faceless labyrinth policing users and saying "tut tut, you said a word prohibited by our code of conduct" and being able to jack you.

There was actually someone in the 360 forum the other month complaining that he got banned for having "Skinhead for life" in his Xbox Live profile, upon further questioning it turned out he's one of those UK skinheads who listen to reggae and oi, not the racist skinheads who beat up minorities.

Try explaining that one to the $10-an-hour folks who work in customer service.
