well, i knew it just a matter of time for sony to face ANOTHER lawsuit in connection with the gaming devices.....

with sony's history of losses and settlements, one has to wonder just how much time the ps3 really has.....

SCE just can't continue to drain sony like this...

Big companies get sued all the time for so called infringements like that. No way the ps3 gets recalled because of that. Worst case scenario, they just have to pay some arbitrary figure in damages, but it's unlikely they would even go to court.

This company pattented parallel processing.. in '91...? Why dont they sue intel and AMD, because their chips have parallel processing too. Patents last 17 years, that means this one is about to run out. Looks like they're just tryin to make some quick cash.

So a greedy company is going to try and shut down the Cell processing unit which is advancing technology and the future CPU. Not only is it for gaming, but beneficial for medical research.

They won't win.

Playstation 2 had the same type of problems and they never pulled those of the shelves. There won't be a Playstation 3 recall, this company is clearly after money.

since we don't know the technical details of the patent we don't know if they would have a case against intel or amd. we do know that the cell is not like the intel or amd designs so that may be a reason.

Yep, they are quite profitable it seems.

And no the PS3 will not be recalled; this case is all over the place. Sue Sony, but not Toshiba and IBM? who all helped with the Cell CPU. Oh wait, it's because the PS3 is a cell-based product that's selling moderately well; I know a quick 'money-grab' when I see it. Patenting is getting ridiculous.

I'm not giving my PS3 for a recall! No way, I will keep it in my arms and I won't let go. I don't think this will happen. What will happen? Will the PS3 break or something? Why would they have a recall? I'm really confused!

Are you sure about this? I am an attorney but not a patent attorney. Would it not be possible? Again, I don't know. I am sure cash would solve this whole problem. Usually does.

They patent a theoretical process in 1991, then do nothing for 16 years until several large computer and electronic companys begin to make processors that use a similar process and begin to mass produce them before slamming one of them with a lawsuit. Why did they wait until now to file a lawsuit, the Cell has been in development for well over 3 years? Because they wanted to leech off of companies that actually spend money to advance technology. Thats being greedy.

If Sony wanted to just make money they would of just gone with the standard processors used in the other consoles.

that sucks. the ps3 and sony are litigation magnets. first they were getting sued for (still are getting sued for) patent infringements on the dual layer bd's, then the european union just started to investigate sony and the bda for unlawful business practices, and now another company is suing sony for patent infringement on the parallel processing of the cell. hell just look at the name of the company, Parallel Processing Corporation. sony is going to need more than bs pr propaganda to get tham out of all this. (ironically, ms was the one that told the eu to investigate the bda. for those that don't know about ms's history with the eu, or here in the us with the judicial system, shame on you.)

Interesting but there won't be a recall. These types of suits always start off saying give me all profits, stop making the infringing device, and pay me billions in penalties.

But they want to settle so they setup the worse scenario possible if it goes to court and sony loses. Look at RIM (Blackberry) and the lawsuit they lost. They actually had to turn off their service, but then they quickly settled paying millions to the company they stole their idea from.

*IF* this company wins it will just mean Sony will ose more money.

Not true. You can sue anyone that infringes. Sony can then sue IBM (if they have a case). But you can sue anyone you wnat that has infringed.

A recall would never happen even if the merits of the suit are based on fact. The suit will never go to trial, just like 90 percent of all lawsuits. It will be settled out of court for an undisclosed amount allowing PS3 owners to continue to enjoy their no-games.

everything you have just stated is what happened in the verizon/vonage case. verizon was wrongfully awarded a patent and they used this extremely broad patent to sue vonage. though verizon won the case, vonage appealed the injunction and won it allowing them to continue their business. currently, vonage has asked for a retrial to further state their case using the new definition of what constitutes a patent. link

a patent is a patent. they have 20 years to use to patent solely or to licence it, afterwords, it becomes public domain. here's a fact for you, in 2006, the us government decided to end a certain phone tax becasue it was originally used to pay for a war that no longer existed. this phone tax was used to fund the spanish-american war over 100 years ago and was still being collected by the teleco's until last year. link
