Rocktober trademarked by...Activision?

Yep.

When Activision sent out a press release this morning regarding a Guitar Hero DLC discount, we couldn't help but notice a tiny trademark symbol dangling precariously above the term "Rocktober™." That got our mind grapes juicing: Isn't that the term EA has been using to market Brütal Legend's upcoming OctoberRocktober 13 release? It is!

Low and behold, we turned up an Activision trademark filing for "Rocktober" dating all the way back to 2007. An EA representative was unable to comment at the time of this posting, but assured us we'll have an official statement from the publisher soon. We've also reached out to Activision for its side of the story. In the meantime, we've dropped the text from Activision's press release -- or as it's no doubt being dubbed by lawyers, Exhibit A -- after the break.Joystiq

i say we all throw in our support for brutal legends, i'm not a fan of music games but this is absurd, that term has been around for so long, you can't trademark it, rally the troops! if no one here wants to act out against activision i'll go over to **** see who else we can scoop up!

Well, Microsoft did once try to get a trademark on the word "Word", and that didn't end in their favor :P But anyways, i'd guess if Activision can't have the game, they'll ruin the developers :P

The systems of patents and trademarks are VERY strange...

Well thats what they get for giving up on BL. Activision is so busy milking their franchise that they seem to forget what an original IP looks like.
