Old news. You can also opt out by writing a letter to SNEI informing them that you do not wish to agree to that term.

You cannot be part of any class-action suit against Sony if you agree. It's in line with a precedent recently set by the Supreme Court in the USA, with regards to AT&T. It's unsure as to whether this would have any effect outside of the US, or possibly just California in particular (I think this only pertained to the individual state).

You can blame the Supreme Court then. It's the decision made by them which set this precedent. You will likely start seeing it in more and more contracts.

Indeed. My mom actually wants me to do that. I'm too lazy though >.>mrmusicman247

:P It's not a huge deal, unless you were looking to file as part of a class-action. I'm not gonna bother... But I definitely don't blame people for opting out. It's a good idea.

blaznwiipspman1

Yes, and yet, it's simple as pie to do. At least they are giving you the option of opting out.

As for MS, you'd be surprised. This was a precedent set by the Supreme Court, not Sony. It's their ruling that will allow more companies to start doing this.

This was already posted but w/e.

Here's the deal. When agreeing to this (you can't access your online account until you do so) you are waiving your right to sue Sony with other customers as a collective unit. However, you can still pursue legal action on an individual basis, whatever it is in a court that you wish to. This is to prevent the suehappy customers from suing Sony in the "name of millions of customers." Warranties are still valid, restrictions are still there, nothing else has changed but that one specific thing.

Is it right? No.

Am I willing to fight Supreme court ruling over this matter? Absolutely not.

Now before anyone decides to be a vigilante and lead the charge against Sony, make sure you aren't a member of AT&T or T-Mobile (there are some other companies doing this I can't remember off the top of my head) because they have the same rule in their contracts.

Yes. Within 30 days of you agreeing to the terms, you can opt out of this particular part.

This is being utilized by a number of companies, not just Sony. It's very smart for them to do this.

This is probably because of the time when Sony lost all 80 million users credit card information and other personal information with their crappy online security. This just means consumers have no protection anymore when Sony seriously effs up. If they screw you over, then you cant do anything. My suggestion to every psn user is to never use their credit card to buy anything online. If you want to buy something then get a psn gift card from walmart and use that instead.

You can still sue them, or resolve any issues through arbitration. This isn't a blanket "you can't sue us, haha!" Furthermore, it's unlikely something like this would hold up outside of the US, and possibly not even all states within the US will recognize it.

Furthermore, again, you have the option to opt out. Yes, Sony is giving the consumer the option to opt out. You do not have to agree to this.

Anyway, getting your CC info stolen is nothing... Just report it lost/stolen, receive new card in the mail within a week or so.

I hope you're right about that, and this only affects a select FEW 1 or 2 states and nothing more. The option to opt out is only 30 days, and how many of the psn users will actually do that? Maybe 100 or 200 tops? Sony is taking advantage of the fact that peoples are uneducated about the law. Also I wouldn't want a hacker to know my address, phone number, spending habits, etc etc.

blaznwiipspman1

It doesn't matter if it's for 30 days... The option is still there for people. Who knows how many will do it? How many are likely to enter into a class-action suit against Sony? It's just pointless to assume anything. The fact remains, anybody who wants to opt out, can do so.

Everybody takes advantage of everybody, hence why we have sayings like "It's a dog eat dog world". That's life. Sony are trying to protect themselves, legally, yet are still giving us the option to pursue a legal suit if necessary (either alone, or in a class-action if people opted out).

Nobody wants a hacker to know that information, naturally. However, the chances of one individual being able to do anything with that information is slim. Heck, just about every company in the world has access to that information. Companies sell it on all the time. What's stopping a disgruntled employee stealing that information? Heck, we don't even know if these companies correctly secure any of the information sold on to them.

Nah, you can. You can either opt out, or just sue them individually. There is also the option to resolve the dispute through Sony's arbitration process.

Don't bite the hand that feeds you.

Both MS and Sony did so numerous times.
Nintendo has never done that to me.

Next gen I'll stick to my nintendo + pc choice.
Makes me play pretty much all non generic high quality titles anyway.

I predict next generation the M$ and Sony fans will lose twice as much money as they initially expected, on repairs, service price increases and unincluded proprietary hardware.

Well Sony has taken a lot of features out of the Playstation 3. Since it launched it has lost quite a bit. And then with the Hacker incident. Sony has to do it best. Few few class action suits are "real" and with just cause. I have not problems with Sony's TOS since I just want to play videogames in peace.

I'm not big on suing, but if I learned that my CC information was stolen from Sony servers by SQL injection or some other primitive means I would entertain the thought of getting in a class action suit, especially if my identity had be stolen as a result of there negligence. Class action suits aren't about making money, they are about punishing and preventing negligence.

agreed...class action suits aren't about making money, hell the pay off if there ever is one, is usually like $20...a couple of coffees or a big mac combo.

I happily accepted the terms and would never consider suing Sony. Heil68
What if something happens and you change your mind? Too bad.

Sony made it easy enough for hackers to just walk in. I heard the security flaw was already mentioned to sony MONTHS before hand, but sony just let it be.

and the government knew about what terrorists were going to do with 9/11 before it happened. there are many implications and factors that you, me and everyone else here don't know anything about, but you know i'm sure sony knew that hackers were going to bring down their networks and cost them millions of dollars, yep they just sat back and watched them do it, no no no, they helped them do it, yep yep.

Horrible policies implemented by sony, but legal which is the saddest thing, the fact is that if you have a contract with AT&T or T-mobile you already gave up your rights to sue,and any problems you have with them have to be solve in arbitration, which is a judge pay by them. I don't like this at all,but there is several options, opt it,or better erase all your data from PSN and change it for a dummy account.

[QUOTE="lhughey"]I'm not big on suing, but if I learned that my CC information was stolen from Sony servers by SQL injection or some other primitive means I would entertain the thought of getting in a class action suit, especially if my identity had be stolen as a result of there negligence. Class action suits aren't about making money, they are about punishing and preventing negligence.blaznwiipspman1

agreed...class action suits aren't about making money, hell the pay off if there ever is one, is usually like $20...a couple of coffees or a big mac combo.

You're exactly right. I've received a couple of notices before that I can be a part of a class action reward, however the rewards have only been like $10, so I never sent in the required information to get the reward. I'm just glad that there are people out there keeping corporations honest (to an extent).
