You cannot be part of any class-action suit against Sony if you agree. It's in line with a precedent recently set by the Supreme Court in the USA, with regards to AT&T. It's unsure as to whether this would have any effect outside of the US, or possibly just California in particular (I think this only pertained to the individual state).

You can blame the Supreme Court then. It's the decision made by them which set this precedent. You will likely start seeing it in more and more contracts.

As for MS, you'd be surprised. This was a precedent set by the Supreme Court, not Sony. It's their ruling that will allow more companies to start doing this.

Here's the deal. When agreeing to this (you can't access your online account until you do so) you are waiving your right to sue Sony with other customers as a collective unit. However, you can still pursue legal action on an individual basis, whatever it is in a court that you wish to. This is to prevent the suehappy customers from suing Sony in the "name of millions of customers." Warranties are still valid, restrictions are still there, nothing else has changed but that one specific thing.
Is it right? No.
Am I willing to fight Supreme court ruling over this matter? Absolutely not.
Now before anyone decides to be a vigilante and lead the charge against Sony, make sure you aren't a member of AT&T or T-Mobile (there are some other companies doing this I can't remember off the top of my head) because they have the same rule in their contracts.

Yes. Within 30 days of you agreeing to the terms, you can opt out of this particular part.
This is being utilized by a number of companies, not just Sony. It's very smart for them to do this.
This is probably because of the time when Sony lost all 80 million users credit card information and other personal information with their crappy online security. This just means consumers have no protection anymore when Sony seriously effs up. If they screw you over, then you cant do anything. My suggestion to every psn user is to never use their credit card to buy anything online. If you want to buy something then get a psn gift card from walmart and use that instead.

It doesn't matter if it's for 30 days... The option is still there for people. Who knows how many will do it? How many are likely to enter into a class-action suit against Sony? It's just pointless to assume anything. The fact remains, anybody who wants to opt out, can do so.
Everybody takes advantage of everybody, hence why we have sayings like "It's a dog eat dog world". That's life. Sony are trying to protect themselves, legally, yet are still giving us the option to pursue a legal suit if necessary (either alone, or in a class-action if people opted out).
Nobody wants a hacker to know that information, naturally. However, the chances of one individual being able to do anything with that information is slim. Heck, just about every company in the world has access to that information. Companies sell it on all the time. What's stopping a disgruntled employee stealing that information? Heck, we don't even know if these companies correctly secure any of the information sold on to them.

Nah, you can. You can either opt out, or just sue them individually. There is also the option to resolve the dispute through Sony's arbitration process.

Well Sony has taken a lot of features out of the Playstation 3. Since it launched it has lost quite a bit. And then with the Hacker incident. Sony has to do it best. Few few class action suits are "real" and with just cause. I have not problems with Sony's TOS since I just want to play videogames in peace.

I'm not big on suing, but if I learned that my CC information was stolen from Sony servers by SQL injection or some other primitive means I would entertain the thought of getting in a class action suit, especially if my identity had be stolen as a result of there negligence. Class action suits aren't about making money, they are about punishing and preventing negligence.lhughey

You're exactly right. I've received a couple of notices before that I can be a part of a class action reward, however the rewards have only been like $10, so I never sent in the required information to get the reward.
