Joke thread? It is $59.99 when I go to the URL. Where are you getting it is $5?

KevinButlerVP
they must have fixed it, how ever I think there's gona be a lawsuit if some one doesn't get there copy for $5 lol

doubtful, they have the ability to cancel or honor it (most likely cancel) however if they charge you more for the actual price then yes there could be lawsuits, btw this was up on cag way early last night.

People sue over anything. so I wouldn't be surprised if someone tries to sue them

if you read the fine print, besbuy has the right to terminate it (as long as you get your money back it's not against the law), it's bad business but not against the law whatsoever.

No there won't because it's a pre-order. Best Buy reserves the right to refund your money and cancel the order. Unfortunately you have ZERO legal recourse for a pricing error.

It won't, they will refund your money, I remember this exact same thing happening for an expensive television, nobody got the TV for cheap, just their money refunded.

But still, don't they have the right to refuse if some error like this comes up?

No, because that would constitute false advertising.

Imagine this: you have a site that sells videogames, and you decide to price every game at $1. After thousands of sales, you say it was an error and refund everyone their $1. Chances are, some of those people will buy from you anyway, since you're pricing it at the standard price and they know the site anyway. Presto, free marketing technique.

^ If this was legal, everyone would do it. Thus, it is illegal.

bestbuy did this once with hdtvs. they sold them for like $100 and then gave everybody a refund a week later and admitted it was a mistake.

I hope not. i just ordered 6 copies....

Rev3nger

Taken staright from their website:

"Prices and availability of products and services are subject to change without notice. Errors will be corrected where discovered, and Best Buy reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Best Buy will issue a credit to your credit card account in the amount of the charge. Individual bank policies will dictate when this amount is credited to your account. If you are not fully satisfied with your purchase, you may return it in accordance with Best Buy's Return Policy"

I ordered a copy as well just for the heck of it, but lets just be realistic ;)

Ah, okay. I retract my statement(s) then, they have their asses covered.

Still, this can be used as a cheap marketing technique, and I think that even with that ass-coverage a good lawyer could sue them.

Yeah in Canada there is a bait and switch law that protects the consumers from this. I haven't read up on it but I'm sure a case could be made there.

I'm pretty sure that if they cancel the order and don't charge you anything, they're fine.

I went through a similar experience with Amazon a few weeks back.

A few hours later they canceled my order and charged me nothing.

It's certainly disappointing, but it makes sense.

Even if they charge they will simply refund the money. Someone at Hardforums tried to buy a TV that was mistake on bestbuy - ordered it for $200. Turns out he was $2 short so his bank charged him an NSF fee. Best buy then cancelled the order, but reapplied the fee (another mistake on their part). His bank charged him another NSF fee. Cost him $60 and legally it was noones fault but his own.

I'd assume that intent matters here - a single honest mistake is going to be treated differently than a pattern of abuse.

[QUOTE="-Melix-"] Yeah in Canada there is a bait and switch law that protects the consumers from this. I haven't read up on it but I'm sure a case could be made there.

1. Bait and switch laws apply to PHYSICAL stores, i.e. getting a customer to drive out to your location, only to find out the advertised unit doesn't exist. Since a website constitutes almost no loss of a consumers time, and the pricing was accidental, it would be almost impossible to make a case against them. 2. You can sue anyone for anything, the problem is you won't have a case. You'll go into the courtroom, Best Buy will show their pricing error policy, explain the refund, offer an apology, and point out that commercial code does not require them to compensate you further. You'll be out $5000 in lawyer and court fees, but maybe you'll feel better? - The whole implication here from everyone is that Best Buy somehow screwed you over by having a pricing glitch. How? You know Starcraft II isn't $5, you KNOW that, for a fact, people come on here every day to complain that Starcraft II is going to be $60... so really, let's not BS here. Everyone is just in a twist that they didn't get a steal on the game... that they knew was a glitch in the first place... so really, being mad that you didn't get to screw Best Buy over? Silly.

Wow people must not read other posters messages. The same information has been posted 22953 times in this thread. Yes we know the orders will be canceled and yes we know the same error was made with HDTV's in the past......... :p Still a good story though.

Somewhere on that site it says "They have the right not to honor a misprint" or something like that. I remember a 52" was mistakenly priced for 9.99 lol.
