The 3DS's lower screen has been reported to scratch the upper screen when closed

It's about the menu buttons on the 3DS, and on my 3DS the menu buttons are above the screen when closed. Why are people insisting that this device is bad or unhealthy or wrong?
It works great so far. The only weird thing that happened is that the text on my pc screen appears to be floating in front of it. Which is actually kind of cool.

Since this is the case all it would take is you to bump your pocket while the 3DS is in there to have a chance at leaving a scratch on the screen. I would deffinitely get a screen protector and am about to text him right now about the problem, even if it's not widespread.

I've seen multiple youtube unboxings where they just smack it all the way down instead of gently closing it.
