Today I lost all my faith in Microsoft and am seriously thinking of suing them..

Last July I went on a trip to Colorado (beautiful place, btw) and bought an Xbox 360. Since I live in Brazil and microsoft had not yet launched the Xbox in my country I bought it with pleasure. Now for my unpleasure Microsoft out of nowhere launched the console oficially two months later. It cost 1500 dollars for a Premium package with three games and has national warranty.

In early February the console showed me the three red lights. "Let me call assistance then", I thought to myself. I called them and the attendant told me that every console bought outside of Brazil would have to be returned to the original country so that it can be repaired. That was on February 10th.

Since Carnival happened two or three days later I prefered to wait for the parties to end since the Post Offices didn´t work properly.

By Frebuary 22nd I had my console ready for shipping and had the idea of calling to Microsoft support to check if all my information was correct. That was the last minute I had faith in Microsoft, here´s the talk I had with the assistant (translated, of course)

"Hi I would like to check my information before I send my Xbox to the US, would you please confirm my adress and Reference number?"

"Sir, are you aware that the rules for returning to USs Microsoft has changed"

"No, what has changed, do I have to pay for the shipment, that wouldn´t be a problem..."

"No, Sir the new rule says that Microsoft won´t send the repaired consoles back to your country, do you know anyone who you can tell microsoft to send to so he/she can send it back to you?"

"Wait a minute, let me try to understand the situation, Microsoft from Brazil can´t repair my system because I didn´t buy it here for the humongous price of 3000 R$, so I have no right to a warranty, am I correct so far?"

"Yes, sir"

"And then, when I contact you two weeks ago to know what I have to do you tell me to send it to texas, right"

"Right, sir"

"And now I can´t get my console fixed because "The Rules Have Changed"?"

"Correct, sir"

"HOW THE HELL DIDN`T YOU CONTACT ME BY E-MAIL OR PHONE THAT THE RULES WOULD CHANGE?! WHEN did these new rules were invented?!"

"In Frebuary 20th Sir"

"TWO DAYS AGO?! So you are telling me that I can send the console, but it will never come back?"

"That´s why I asked if you have a friend there, sir, don´t you?"

"NO!!!"

"(Very arrogantly) Then I´m sorry Sir, we can´t help you. (She Hangs the phone in my face)"

Now I got an appointment next week with my lawyer to talk about suing both Brazil´s Microsoft and US´ Microsoft for misleading information reguarding their products warranty and quality.

What is the opinion of SW on this?

You can win. THey will pay you off as soon as they realize you will be a pain in the butt. Make sure you have everything documented (paper trails, receipts, etc). And search the web about how to sue a company from your perspective. You'll have to file something in court (im not sure about how it works in your area). But hey, make it your hobby. Approach it from the perspective of a new experience. You will walk away a smarter person either way and you have nothing to lose.

  Oh, I guess I will, I´ve seen cases of Microsoft here in Brazil having to repair the DVD Driver of a foreign 360.

  "Microsoft will repair your console if you try to sue us for money" should be the first line in the 360´s warranty.

  Of all cases that Microsoft here in Brazil got sued because of foreign 360s it lost all, I just was trying to cooperate with them before today.

Dude. Box it back up, make it look as new as you can and sell it on the Brazilian equivalent of craigs list or ebay.

You could actually turn a profit... and screw over some poor excited gamer...It's a win, win if you ask me.

Ain't that the sad truth of his situation. He will be paying that amount for the lawyers phone call. That does suck though, I would try speaking to the supervisor of MS' customer service. They have been pretty good for me and for many other's that I've read about on these forums.

you're lucky that they were even going to do it in the first place.....It sucks for you, but it makes perfect business sense on their part. btw, what took you so long to get it set for shipping? Why did you wait for the Carnivals to start and end when you could've gotten it sent out immediately right after you got off the phone with them? Try all you want, but you won't win this battle. It sucks and I honestly know what you're going through cause I just accepted the fact that my HDTV won't ever get serviced....:(

Ummm no he needs the law on his side. What is his claim: breach of contract. Documentation is nice, but you need law on your side too.

No decent lawyer plays video games, or maybe u r a half a$$ laywer. There are alot of those.

Excuse me? I play video games and I am a good (not great but working to get there- it is a tough profession) lawyer. I can see you judge a book by its cover and you sir fail at this. Good day.

If this is true, than that does suck, sorry to hear that, but you should just have someone in the states take care of this for you. Suing them will do nothing except drain your pockets, hell, the US Government had trouble suing them.

  Haven´t you listened, my COUSIN is my lawyer, and BTW people here in Brazil got their 360 repaired for much less.

  Microsoft are crying babies, they tag along with anything if you threat their pockets.

  They never anounced launching the 360 here until the day it got launched. And they only mentioned that only Brazilian consoles would be repaired here one month after they had launched it.

  They tossed a pile of S*** over all brazilian owners of 360 that day, and that makes a nice case in the law.

What ways? The best is to call MS and speak to a supervisor. I agree using a lawyer in this, unless it is a family friend, would be a waste. I am simply stating that it does not appear that he has a cause of action.

Now I got an appointment next week with my lawyer to talk about suing both Brazil´s Microsoft and US´ Microsoft for misleading information reguarding their products warranty and quality.

What is the opinion of SW on this?

Ain't that the sad truth of his situation. He will be paying that amount for the lawyers phone call. That does suck though, I would try speaking to the supervisor of MS' customer service. They have been pretty good for me and for many other's that I've read about on these forums.

  Haven´t you listened, my COUSIN is my lawyer, and BTW people here in Brazil got their 360 repaired for much less.

  Microsoft are crying babies, they tag along with anything if you threat their pockets.

  They never anounced launching the 360 here until the day it got launched. And they only mentioned that only Brazilian consoles would be repaired here one month after they had launched it.

  They tossed a pile of S*** over all brazilian owners of 360 that day, and that makes a nice case in the law.

MS customer service was great when I called after they extended my warranty. At first they wanted me to pay $130 plus shipping both ways. Then they extended and covered everything. I am sorry to hear about this. MS is definately screwing you over. Have you tried calling them back to see if someone else can do something more for you.

hey, lawyers are just people like everyone else. Some smart, some stupid. And there are many areas of practice. You dont want/need to hire a lawyer for this. Do this: find out how someone else beat a company. There are many stories of this on the net. I would even resort to calling MS everyday and be a polite pain. When you call, start taking names. Ask for the names of the superiors. Ask to speak to them. Thats just for starters.

To be fair, Sony's support team isn't that much better. There's a reason why their job is answering telephones and listening to people complain about hardware. That being said, Sony's hardware (this generation, for those who feel inclined to point out the PS2 had shoddy workmanship) is more reliable than that of the Xbox360

  Maybe you are right, I am kinda mad right now about all this. I´ll just talk to my cousin to see what can be done... But it is true that MS has repaired consoles for much less. I am not trying to get their money by going to the court, I am just trying to get my product repaired.

  Even if I had a friend living in the US... asking him/her to ship it back to Brazil wouldn´t be polite (In my Brazilian opinion)

No, I can send it to their repair center but they can´t send it back to me because of the new rules.

I get that, but what if you sent it to someone in the states and then they sent it to the repair center? Assuming that would work once it is sent back to the person they would need to send it back to you. An irritating and to an extent dangerous process but that's all I can come up with.

Just buy a new 360... Take the old one back the next day to the store and tell them you want your money back. Remember to put it in the same box as the new one.

Also pray that they don't scan the bar code on the back. :P Unless you peal the new one off and stick it on the old one. But then you can't get a repair later on... Unless you do the trick over again. :P

Excuse me? I do complex business litigation. My clients (actually my firm's clients) are all businesses who are involved in contract and other business related disputes. So please stop trying to hurl insults at something you know nothing about.

Well no offense but you need to understand customer service in corporate retail. You can't expect them to pay for out of the country shipping on an item that was purchased in the US. That would probably not be covered under ANY manufactuer's warrenty In addition, it's completely reasonable that you aren't allowed to send it into the place where console's bought in your country are sent to, as your console being defective is not directly their liability. That's what happens when you take risks like that. To me it sounds like they're fully willing to repair your console for free, but under the guidelines set when you purchased it, meaning it was bought in the US, they would pay for you to ship it back to them from the US, and they would pay for the shipping of the console back to you in the US. Companies don't like making exceptions to guidelines, which is what you are asking. Even if you flip the bill to send it to them in the US yourself, they won't flip the bill to send it outside the US, as that is a specification of their warrenty. I'd suggest getting a friend in the US (if you have any you would trust with this) receive the console, and you reimburse your friend to have it shipped to you in Brasil.

Last July I went on a trip to Colorado (beautiful place, btw) and bought an Xbox 360. Since I live in Brazil and microsoft had not yet launched the Xbox in my country I bought it with pleasure. Now for my unpleasure Microsoft out of nowhere launched the console oficially two months later. It cost 1500 dollars for a Premium package with three games and has national warranty.

In early February the console showed me the three red lights. "Let me call assistance then", I thought to myself. I called them and the attendant told me that every console bought outside of Brazil would have to be returned to the original country so that it can be repaired. That was on February 10th.

Since Carnival happened two or three days later I prefered to wait for the parties to end since the Post Offices didn´t work properly.

By Frebuary 22nd I had my console ready for shipping and had the idea of calling to Microsoft support to check if all my information was correct. That was the last minute I had faith in Microsoft, here´s the talk I had with the assistant (translated, of course)

"Hi I would like to check my information before I send my Xbox to the US, would you please confirm my adress and Reference number?"

"Sir, are you aware that the rules for returning to USs Microsoft has changed"

"No, what has changed, do I have to pay for the shipment, that wouldn´t be a problem..."

"No, Sir the new rule says that Microsoft won´t send the repaired consoles back to your country, do you know anyone who you can tell microsoft to send to so he/she can send it back to you?"

"Wait a minute, let me try to understand the situation, Microsoft from Brazil can´t repair my system because I didn´t buy it here for the humongous price of 3000 R$, so I have no right to a warranty, am I correct so far?"

"Yes, sir"

"And then, when I contact you two weeks ago to know what I have to do you tell me to send it to texas, right"

"Right, sir"

"And now I can´t get my console fixed because "The Rules Have Changed"?"
