I'd put my money on Uncharted 2 for GameSpot and Modern Warfare 2 for most others.

Not true, Spike TV gave a GOTY to Madden one year. Granted, it's a LOL-worthy award, but an award nontheless.
I expect it to come down to UC2, DA:O and Batman:AA. However because it's Gamespot and it seems that hype rules, expect to see MW2 in the running if not winning it outright.

Yes, part of it is that at the end of the year, individual editors don't necessarily share enthusiasm equally for every game. I don't want to share the details of our GOTY discussions, but some things to consider:
1) How many many excuses do you have to make for it? Is it awesome, but also buggy? Has it developed online connection issues? Is the multiplayer awesome but the single-player not? Is it not an entire package?
2) Will you still be playing this game in a year? When you look back on 2009, what game defined the year? There's always a bit of fortunetelling involved.
3) Did it change the way you think about games? Did it do something unexpected and unique? Did it make you wonder why no game has done that before? Did it rethink a genre, or introduce one? When you play similar games, does this one make you say, if only this game were so-and-so?
4) Did it emotionally move you? Was it fun... but also more? Did you think about the game when you weren't playing, or dream about it?
5) When you think about it, does it get you excited to play it all over again? Do you talk about how wonderful it is with other people?
A score alone doesn't necessarily answer these questions. That isn't to say we question the original scores, but rather, take into account the intangibles. Let's say the best strategy game ever created came out this year (it didn't, btw), but let's say that. But let's say a game also came out that was flawed--but revolutionized games and brought us into the future. (Some folks have brought up Everquest, and that is an awesome example). This is the time when we get to go to our hearts and recognize what a game has done for our lives--and the game that thrills and moves us most isn't necessarily the one that got the highest score.

I think that game is more entertaining, and had more of an affect on gamers, of course im speaking from personal experiences, so i respect your opinion, but batman gets my vote. Pretty much everything he said applies to Dragon Age too (which happens to be the correct answer, incase anyone was wondering), and at least part of his post (specifically point #4) is a damn-near carbon-copy of part of his DA review.
yup it applies to Dragon Age but to be honest even with the great stuff it had, the poor graphics, the constant frame rate issues and overall technical issues are making me a bit sick of the game after playing such games like infamous, assassins creed 2, uncharted 2, batman aa...etc.
I wonder how did it pass the quality test approval with the ugly everything? :P
I don't even believe my eyes that it is coming form the same company that made Mass Effect ( graphics wise, I know there were technical issues but the graphics were top-notch in mass effect and the technical issues were not as bad as DA ).
Im hoping for a patch that corrects the technical issues at least, i can live with weak graphics but the technical issues are making me leave the game sessions quick.

MGS4 lost its momentum a month after it was released, which was in June. It fabulously won GOTY anyway despite the plethora of games that were released at the end of last year. Taking that into consideration, even the long forgotten inFamous and Street Fighter IV might stand a chance.
This is just an opinion though. GS will decide. :)

IMO, it's not any companies job to make a game "an equal experience on all systems"...what they should do is EXPLOIT each system as far as possible.
Unfortunately both scenarios are rare.
