Microsoft has turned down a settlement offer by Motorola Mobility that would have brought an end to an extraordinarily expensive patent dispute which could ultimately outlaw sales of some Xbox consoles in the US.

The Xbox firm is feverishly trying to escape one of the most disastrous legal rulings imposed on the company in its thirty-seven-year history, after the International Trade Commission (ITC) was advised in May to ban the import and sale of Xbox 360 systems in the United States unless the dispute was settled.

Microsoft, which has defied all major outcomes of the case, has warned the ITC that banning Xbox 360 across the US would not serve the public interest, because it would leave the market with a choice between PlayStation 3 and Nintendo's Wii.

Shaw rejected the argument, claiming that enforcing intellectual property rights takes precedence.

Apple and Activision plus other companies don't want the ban to happen, but this is one step closer. People say it won't happen, but this is confirmation that it's coming closer. Will this affect the Xbox 720?

Yes. This is patent trolling. It's funny because Motorola is owned by Google and Google is accusing Apple and Samsung of patent trolling of their Android OS and phones. Google likes to play innocent but this proves they are just as reckless.

That's the problem. They won't launch when they are ready, they will be forced to launch earlier and possibly sacrifice the integrity of the 720. Possibly, unless Microsoft has already started manufacturing the 720.

And nothing of value is lost.

While it shouldn't be banned, I cannot say I'd be sad to see it happen. But I've had three of them break on me and have seen almost no great games come out on it since they released the Kinect. So perhaps I'm just biased.

I feel like as soon as they are able to ban the 360, the new xbox will be on it's way to stores.

This would mean that MS can't support 360 after the launch of nextbox, which will hurt them. They have plans to continue support 360 just like Sony did with PS2.

That would be absolutely insane if the 360 got pulled from shelves and stoped production. I really don't want this to happen because it would be bad news for the industry in general.

You better pay them or something like that Microsoft because if you don't it will be banned in the US 100% and the US is where you get the most sales from. August 23 is D day.

I swear Motorola's original business design was to design hundreds of patents and then sit back and wait for someone to break them. I see them suing more companies for this than anyone else.

Motorola is suing Microsoft for a video codec infringement which is an standard essential patent aka wildly used

Microsoft is counter-suing Motorola for am ActiveSync infringement is a non SEP

THIS means that this lawsuit will go nowhere, which is why MS rejected the settlement. Unless Motorola didnt disclose their ownership of the patent (which is considered misuse), then MS has the rights to use any essential patent they choose. Motorola cant sue MS for infringing on a patent that they didnt fully disclose ownership of or what the patent was for, etc. This lawsuit will go nowhere. There are many companies and corporations using essential patents.
