Microsoft just stated clearly that it can play used games without fee and install it. The way it works is that each CD has embedded serial numbers. So you can install the game and play it to your system.
So say SystemA installed the game. SystemA can play it without CD because the embedded serial number is in SystemA. Now when SystemB borrowed it, the embedded serial number will be transfer to SystemB without fee. SystemB can now play the game without CD. Now SystemA won't be able to play the game, because it no longer has the embedded serial number. The only way to play it again if SystemB gave the CD back to SystemA. Then SystemA will have the embedded serial number back. SystemA can play the game without CD but SystemB can no longer access the game unless it receives the CD again. They call this process Xbox Instant Transmission (XIT).
