It is constitutional, Gamespot has the right to run their own organization however they want, assuming they don't break any legal contracts (and they don't, especially considering most members don't pay them anything anyway).
Once you click "I agree" to the ToS, you waive your freedom of speech and are then subject to Gamespot's regulations. All GS can do is ban you or punish you in their own realm though, they have no further jurisdiction obviously.
