This counts as a capital punishment I believe. Or maybe not even that. All I know is towards the torque bow achievement, you have to shoot them while they are up
Make sure that you are around 15 feet away from a downed opponent before sticking them with an arrow. If you are too close it will count towards an execution. make sure you stand far enough away from them and you will definetly get a torque bow kill towards your achievement.
Yes it counts as a Torque kill. Yes you can do it from a very close range. No it won't count towards Capital Punishment. I know because I got 100+ kills with it yesterday playing Tyro Station all day.
