I don't see how the problem could only be limited to the North American or US versions of Halo 3 LE - since it's all the same packaging. The flaw was in the design of the case, which failed to hold a lot of discs during shipping (thus, scratching them).
Basically, demand another copy and refuse to pay a cent more than you have. If you still want a refund, then be sure to get the full amount, not some "compromised" price.

As for a fix, I'm wondering if you couldn't contact Microsoft support to report the problem? I don't know how useful that suggestion is but it's all I can think of.
It looks like it's going to come down to a fight between you and the retailer who sold it to you.
