well its not coming out till the epic and silicon court dealings are finished. SO maybe mid next year, maybe even late next year. Although if Silicon loses most likely it will be canceled.
It will be coming out eventually. Silicon Knights have invested to much money and time to scrap it now. Whether it's with Unreal Engine 3 or not is the question and if not, how will it affect the game?

Too Human has been shown a few times since E3'06. Most of the framerate problems you speak off are not as obvious. Saying that it's un-original is overstating the facts for sure. No one has played the game in the press and it's assured that you have not either, so don't go calling a game unoriginal until you either play it or have more information. Considering the last time you saw it was E3'06, shows that you aren't a reliable source of information. Too Human wasn't shown at all at E3'06. You might be mistaken with E3'05. Actually, Too Human was playable at E3 2006, that is where all the bad press came from. And now, Silicon Knights is suing Epic for breaking contracts regarding the Unreal Engine 3. Part of that lawsuit is because of the terrible E3 2006 showing. Silicon Knights relied on Epic to do certain things in the contract which they never did. Thus, Too Human was shown in a very unpolished, crappy state.
Because of all that crap, Silicon Knights was forced to change things in the engine, something Epic was supposed to do as per the contract, so that is why the game is getting delayed. Its now delayed to early 2008 but it was supposed to come out this fall.
