i had the same problem, its probably because you are using one of the older wireless controllers. don't worry just phone up their (m$) support line and tell them your new wireless headset wont work with your old wireless controller. that's what i did and they are sending me another wireless controller (and i got to keep my older one as well!! w00t!!). don't worry the phone line is free.

so i was taking a cra and it alll came to me!
you turn the xbox on then turn your wireless comtrollers one.
it sould be in quad 1.
resync controller with xbox.
then syn your headset to your controller.
there you go my friend.

This is a simple solution and you are going to kick yourself when I tell you how to solve the issue. The same thing happened to me btw. Prepare to feel like a moron. So, when you have a new controller or mic, sometimes and for a reason unknown to me, the mic will be set for spot two and represent this with the green dot next to the #2.
To fix this, simply tap or press (do not hold as this will begin the syncing process) the sync button on your mic to cycle through controller connectivity sections 3 and 4. Thus getting back to being connected with controller 1. Simple right! And everybody thought it was broken or some complicated issue to call Microsoft about.
i had a problem where i couldn't sync my wireless headset to my controller while i had a messenger pad on the controller. but as soon i i took the messenger pad off then it would sync up with the headset just fine. never figured it out. instead i just sold the headset and use a wired one now.
Really? I had the opposite problem, gotta keep my chat pad in.
