Well i had a 360 with 5 games and 2 wireless controllers, i needed to get money since i am going to uni soon an need a car to get there. so i posted my 360 for $400, i dont know where the box was, but i was desperate to sell it as is. couple of guys were interested and wanted to buy it. they came to my house, hooked it up, tried pgr3 and call of duty 2, everything was working perfectly. they payed an went on their way. now couple hours later they call back saying they played 30 seconds into pgr and the 3 lights are coming up. now when i had it, i never had this problem. i asked him where he placed he, he said in the middle of the room lying down on carpet. i told him to have it standing up away from carpet, and make sure the powerbar is in open air. now i dotn know wat to do..is this guy messing with me? is he trying to scam me, the seller, by switching it with a xbox 360 he already had that broke down..or am i getting ahead of myself. what should i do? is there anything i can try to clear these red lights...i mean it worked perfectly find when he tried it out.

That sounds really really fishy to me. Did you take your xbox back and give him the money back? Or is that still up in the air.

Ok, well if he's a big guy with lots of street cred, you better do as he wishes. Otherwise say it was a final purchase, especially since he tried it right in your living room infront of you with no problems. It seems like he's scamming you big time, like I really don't see how that would happen in the short span of him driving to his place then hooking it up. Something fishy indeed.

man, that is balls. You gotta tell him, you and him both witnessed that it worked perfectly fine in your house, and made a mutual agreement when selling the system, and theres no way you can give him the money back as you already deposited it in your account, and put a infinity day hold on it. sorry for the stupid sarcasm in my posts, but seriousness isn't my game pl@ya:D.

Ugh, that is not the point of the post. Xtreme isn't worried about whether or not the guy is lying about it being broke but the fact that he might of previously owned an xbox, had it broke, bought this guys, did a switcharoo, and now hes getting his money back, a win-win for the buyer. Or another scenario is the dude busted the 360 because he's a jerk and doesn't know how to treat it, and wants his money back.. and the victim gets the short end of the stick.

as far as i'm concerned, buyer beware... they chose to buy privately and should recognise that that also means no warranty from you... just bad luck for them i suppose.... and yes i think it could be a scam, ( 2 guys buying one box )

Did you take down the serial number of your console? If so have him bring it over and check out the serial# if its not the same you know hes just trying to scam you of course if it is the same and console works hes still trying to scam you but I think if the console works who wouldnt bring it over, he would bring one that doesnt work.

Really there isnt much you can do either give him the money or dont. All you can do is ask him to brinng the console over to see if it works, definitely dont go to him. if he does bring it and you didnt have your original serial# written down and it doesnt work...then you have to give him his money back. No proof its not the same console.

You shouldve sold it on EBAY or something. Selling to complete strangers isnt always the safest way to do things.

Yeah, just keep your money. Say you spent it or something, just don't give it back because he could have easily switched the console and if he didn't, he saw it work and it all just sounds a little fishy to me.

Dont give him back his money there is no reason 2 if it worked for u all the time and then he took it home and it didnt work its not your problem. There was no warenty agreement even if that is the truth that he did nothing to the xbox and it just broke if u personally didnt sell it to him broken then dont wory about it. even if he thinks your screwing him and your a dick who cares your not. 

Would you rather have one person think your a dick and have 400 dollors

hmm sounds like a scammer, did you by any chance write down the serial code on the back so he wouldn't do some swap or remember something distinctly about your xbox 360 to prove him wrong

is the console over a 1yr old??? did you register it???? tell him to bring it over and if the serial #'s match and its under warranty you will call and get him a new one or fixed under the microsoft warranty. if its out of warranty tell him to call its buyer beware besides if he paid 400 and has to get it fixed and hes only got 550 it the thing with the games hes still got a good deal right!!!! no money back in the end.

I completely agree with you, it's not everyday you plan on meeting with a customer that makes out as a really big idiot. You just gotta stick with what were all saying, and keep your money, there has to be someone on here with a legal background that can shed some light on what happens when private buyers attack, or what should be done in a situation like this.

check the hdd see if he switched it. if hdd info is same then i hope u wrote down ur xbox code or else ur screwed.
or if u dont noe ur code, look at the code on that one and check what the date on it is and compare it to ur purchase time

Dear Thread starter,

Dont worry you are legally entitled to keep your money. You are under no obligation to return the money or even accept the return of the xbox 360. Let me give you a lesson in Law 101 when it comes to sale of goods.

You have sold a second hand item, as such there is no warranty guaranteed examples would be like the quality of the item or the aesthetic appeal of it. However you have already provided some sort of inspection of the item by letting the buyer test it in front of you so that frees up your responsiblity.

Secondly the moment the buyer has paid the money and the buyer has taken the item, risk passes to the buyer. This basically means that whatever problems that arrise after the passing of goods is the buyers responsibility not yours.

Lastly and this is key when the buyer pays for the purchase price which is considerably lower than the market price of the item the buyer is impliedly accepting the fact that he or she is accepting an inferior product and as such the risk again is undertaken by the buyer.

Moral of the story you the seller is basically safe and the for the rest out there that buy second hand items always remember you are settling for an inferior product by paying a lower price than the market price.

If you don't know the serial number and stuff of your 360 then you cannot CANNOT give him the money back. He could simply be giving you his broken 360 or whatever you don't know. And since it worked at your house then the deal is 100% done. If he didn't try it out at your house then i could understand but if this went to court he would have to prove that you somehow knew how to play the 360 for a while and prolong the 3 red lights somehow until they got it at their place. I say scam and do not give him the money back dude

Make sure the Serial codes on the back match. Hopefully you wrote them down. He might just try and swap his broken one for yours. He also could of messed it up on the transit. If it was working when you sold it then its there problem after that.

That's scam-switch 101. Do NOT give him his money back or take the system back (because the red ring of doom one he's going to bring back to you will be his old broken one). You were both there testing the one you sold to him and it worked perfectly. Done deal.

I’m assuming you don’t know the xbox serial # of your xbox? If you do make sure the one he returns to you has the exact same number. If there different then there to different xbox’s and keep your money. Might be a big dude though might have to get the cops involved thought also. If you don’t have your xbox # then you really screwed. There no way you’ll be able to prove yourself in or out of court. FYI: Serial # is right underneath the power there’s a oval slot you can push open inside there is a 12 number code. That is you serial # different from every xbox out.

well after prolonged arguing back and forth, he gave up and said he's just going to send it to microsoft. im starting to doubt he was trying to scam me...it seemed like he didn't really know a lot about the xbox, but i told him to keep the xbox in an open area, and make sure its not congested, i guess he did screw it up by putting it on the carpet.
