im already on my 3rd one. my first one keeps getting jammed and it kept scratching my disk. 2nd one when i try to put in a games within 10 seconds it makes a drilling noise and sounds like its gonna explode. and now my 3rd starting to have problems by scrathing my disk. and with all 3 360s i also took great care of them and never moved them when they were on never hit them and always never let them get to overheated. i dont know whats happening to them or maby i just have terrible luck. and the first 1 was from dec 25 2006 2nd was from march 27 2007 3rd was from april 14 2007.spartan-mc

If you get a new oen and it is made after the beginning of July, you should be fine.

If you send back an Xbox 360 in the fall, when they have the better quality xbox 360 out they will give you a new or refurbished better quality xbox 360. To try to get rid of all the defective ones. ( To cut down on losses)

If I bought a broken one on ebay, I would personally just return to Microsoft and get a new or refurbished one. Are you allowed to do that...?
