A lot of video game characters are modeled after real life people, especially celebrities and models. It's a lot easier than creating a realistic person from scratch. Did Naught Dog base Ellie off of Ellen? Probably so.

For games like Mario Kart that were designed primarily for console games, the second screen is just that - secondary to the gaming experience. There's not much it can be used for. Most of the time for racing, adventure, and RPG games it's just a map. To make full use of it, the game needs to be built ground up with the feature in mind.
It would be ideal if there was a list of strict requirements that warranted the ban after numerous warnings. However, a blanket ban for an activity deemed suspicious doens't float my boat. I think that gives too much power to the "banner." It is inevitable that wrongful bannings will take place, but Microsoft should limit that number as effectively as possible. Hopefully their policies linger more towards my first scenario.Â

Nope. That's strictly concept art and nothing more. Concept art usaully does not represent exactly what the game itself will look like. That's why it's concept art. This is an in-game screenshot.Notice the lower resolution and detail than what your pic shows (still looks great though.). My point is that's the kind of example that you use to compare graphic quality.
It may look like concept art but that is the whole premise of the in-game artstyle. Take a look at the game in motion here.One of those developers is Nintendo

Awesome reasoning, there, by a supposedly omnipotent being, sounds a lot more like a spoiled child.
