Ok here's something you can do actually answer his question he never once stated anything about giving your opinion. FAIL! This is a GREAT game, by many peoples opinions may I add.

To the TC - sorry to hear, but unfortunatley it may be a bad copy or it may be an emulation isuue. If you look around and search I know there are lists (on the internet) of all known issues on Xbox compatible games.
