They region locked the registration webpage, they detect where you are connecting from, and lock you out if you aren't in Japan, the same thing is going to happen during the download days, people who illegally acquired the japanese beta code (as in, provided fraudulent information), will be instantly locked out, and perhaps even banned from PSN.

The only way to get it in North America or Europe is to pre-order MGS4 from a retailer that is a participating member of the program.

and can i redownload it from a guy that preorder the game

Nope, unlike most PSN store items, it's a "give away" item, and cannot be downloaded onto multiple systems. Seriously, just pre-order the game if you want it so bad, the beta test isn't even long, it's like 2 weeks long :D
