Sorry, but sony have already done that with the psp. My psp was a v1.5, i bought burnout legends, wouldn't run until i installed firmware v1.51. GTA:LCS Wouldn't run on a psp that was running a firmware version below 2.0.

They keep updating their firmware on the psp so users can't run games from the memory stick.

So forcing firmware updates to play certain games is very possible, as in if a game needed access to a external hard drive, the wii would need an update before that game could be run.
