If you don't own the original you'll have to pay 9.99$ for Challenge. Quite a reasonable price for enhanced Order of War multiplayer component (the entire game costs 40 on Steam)!

As for the pirates, well, believe it's not a big problem for them to hack patches, DLC's and other stuff so there's no way a developer can lessen piracy by releasing updates (free or "buy-to-play").

I've just heard that these guys are going to release a FREE (for the owners of the original game) add-on to Order of War soon with new maps, modes and content. That's f***ing awesome! Should all developers support their titles in this way and not make their fans pay 10+ bucks for mission-packs?
