Xbox One's Offline Pass Is an Ill-Conceived Tax

Microsoft spent an hour explaining why the Xbox One should be the centerpiece of your living room entertainment experience. However, in just one sentence, it may have destroyed its upcoming console's appeal as a gaming platform. Used games, an aspect of this industry that has thrived for decades, may come with an extra cost in the future. Apparently, you may no longer buy a dust-coated game or lend your favorite offering to a friend without throwing money Microsoft's way. The Xbox One is attempting to squash the pre-owned market, and if such a detrimental tax is implemented, it will have disastrous results for the sustained health of Microsoft's third console.

In a statement to Wired, Microsoft stated that "on the new Xbox, all game discs are installed to the HDD to play." Once the game is tied to an account, if another person wants to play it on their system, they will have to pay an undisclosed fee. Microsoft did say it will reveal its used-games plan in the future, but examining the facts as we now know them, this policy seems inspired by the online passes that some current generation games require for connected play. Microsoft is essentially implementing an offline pass. And how could its unannounced plan alleviate this excessive burden? Maybe Microsoft will let you play off the disc for a limited time before you're forced to shell out money, or maybe every game will be required to have a demo. Either way, the used-game, rental, and lending markets will dry up.

The Xbox One is an entertainment curiosity rather than the next video game revolution.

This draconian policy has been slowly building for the last decade. As digital games have become more prevalent, so too have the measures to limit their post-retail distribution. Xbox Live Arcade and PlayStation Network games are tied to the accounts that purchased them, and Steam users have dealt with a similar barrier for years. And the mobile market, which has been heralded as the future by so many, is in the same situation. The idea of a game being playable only by the person who first spent money on it has existed long enough that such a move on Microsoft's part should be expected. However, this is the first time any company has tried to destroy the resell market for disc-based games, and it's that distinction that's so important.

People have long embraced the used market in all forms of media. Whether we're letting a friend read our copy of The Catcher in the Rye, browsing the used-CD rack for vintage Pearl Jam, or picking up a cheap copy of Jurassic Park III to see raptors talk, we've become accustomed to borrowing or cheaply buying once-loved entertainment. And this has been a core aspect of gaming for longer than most gamers have been alive. We like the idea that once we buy a physical product, we own it. So it's baffling that Microsoft would ignore years of consumer tenancies with this extortionist tax. As long as games are on a disc, people will expect to be able to lend them to friends without having to pay Microsoft for this privilege.

Video games can be expensive, much more so than other media, so shelling out $60 for a dozen hours of entertainment is a tough pill to swallow. We've found ways of enjoying our favorite pastime without going broke. Borrowing some games while purchasing others has been a practice of many people for years, and there's no reason such a philosophy couldn't serve both consumers and publishers going forward. Microsoft is burning bridges if it decides to enact an offline pass. It will create an infrastructure that is even more punishing for new intellectual properties. People will be less likely to try an untested franchise if they have to pay full price for it, so Microsoft is just pushing the industry further into the innovation-be-damned mentality that has been a plague the last few years.

Ultimately, consumers determine the success or failure of any company.The importance of catering to people with money to spend cannot be overstated, and Microsoft is hurting that relationship, possibly irreparably so. There is no way to spin this extra fee so that it's more palatable for the buying public. This is unabashed greed, pure and simple, and the defining aspect of the Xbox One. Microsoft wants to be everything to everyone, your one-stop shop for television, music, movies, Internet access, and video games. However, such integration isn't worth emptying your wallet for. It's not worth giving up your rights as a consumer. A disc or cartridge is ours to do with what we choose, and until Microsoft acknowledges this fact, the Xbox One is an entertainment curiosity rather than the next video game revolution.

If the price of new games came down I might not mind this, but I know they won't. It's already bad enough that I have to pay for LIVE to use other services I pay for like Netflix. Microsoft, I think I'm all out of nickels and dimes.

Still don't understand why a company would do this (excluding the money), they already make people pay for an online membership (live) so now if I buy a used game I have to pay for a pass and a live membership just to unlock all the features in my game? Sorry Microsoft but I'm gonna make like Cliffy B and Bungie and jump ship.

I really like my Xbox 360 and i was looking forward to the xbox one, but if they do this, and that other thing about requiring to connect to the internet at least once a day i might just buy the PS4 instead

I agree. I've always been a Xbox fan. Loved both of them and liked the idea of supporting an American company in a world controlled by Japanese. That being said, the idea that I could not share games with my son or have to install every game on HDD is really unappealing to me. I never thought I would say this but the PS4 might be the way I'll go this time around... Fffeeewww... That was hard for me to admit 'cause I really hate the Sony controllers.

So if I want to buy a game for my son and I, not only do I have to fork over 60 bucks, but then I have to pay a fee so he can play it on his profile? Yeaaah, why don't you just go a head and go F yourself Microsoft, back to Sony I go. This reveal was far more disappointing than I could of ever imagined.

And they care why? Used games don't contribute funds to support game development. I don't understand how this is a problem. Steam has been doing it for years and it works perfectly. If your friend wants to try it out then they can come over or you can lend them your account. Are we beyond the days where people actually physically hang out face-to-face with one another?

@Ghost_702 The point is though Xbox is american, it is targeted outside and not all people are able to shell out the extra buck. So if stream is successful here it isn't in somewhere else. I live in the East and we do really love to hang out and exchange games and talk about it later. Most people here don't believe in gaming for adults and consider them for kids. We established a community that think otherwise and trying to reach the status of E sports. MS is not helping at all.

@lokar82 @Ghost_702 Agree. When Steam has some sort of "Bundle" pack sale of say....all Supreme Commander games in one pack for $29.99...I'm buying it. They still install to your HD. I even have seen people manipulate the .ini's and improve the games they have installed in many many ways. Yes, it's not like having the discs in hand, but the games are on your pc and you do not have to be online to even play the steam games.

@Ghost_702 Aside from that, I didn't hear any mention in how that "used game fee" is going to be distributed to the developers of that certain game. Is Microsoft going to charge you the money and then give a percentage of that money over to the developer so they don't lose money in used games? Unlikely.

There were so many options before imposing this tax nonsense:

1) charge less than $60 per game, they would definitely sell more and make up for it

2) integrate a voluntary fee for people who play used games and still want to acknowledge the developers for a good work

3) At least have each disk install itself 3 - 4 times to cover up for lost / changed accounts and other family members in the same house

4) Create a sort of joint venture with retail game shops to have a small percentage of used game market back at developers

5) Hell, maybe even have DLC link to accounts if necessary, but optional is the key word for gaming that needs to prevail

But no. Now you'll get people to buy the PS4 or stick with PC, incentivize code breaking piracy, generate an xbox account market where people just rent out their accounts and have everyone abandon your sinking ship.

I'm a huge Microsoft fan, hell I even have a windows phone, but I doubt I'll be buying this console. It's a sad day. I guess it's back to exclusively PC for me.

Not a fan other either system right now, but I don't know if I can support a system that requires you to be online to watch movies, makes you pay for an offline pass, and makes you pay extra for playing used games.

I really wanted to love X1, but the fact that they are doing this is so disgusting, I'm done with xbox. I almost never buy or sell used games, but the fact they are using technology to remove our rights to buy and sell our property is despicable. Not everyone can afford new games, and not everyone likes the games they bought. The used market provides a valuable service by letting more people BE GAMERS. They are shooting themselves in the foot by baring some of their biggest fans from becoming gamers. High schoolers and university students are probably the biggest demographic, but also have the least funds. Make xbox unaffordable to them, and you've lost a customer to Sony for life. Idiots.

I am 34 years old, and I spend between $400-$500 dollars on new games every year, and I spend an additional $200-$300 on used games every year.I really do enjoy Xbox and their products, and I am loyal to their brand, but if the Xbox One does not allow for; the renting of games, the trading and sharing of games and most importantly the buying of used games as an alternative to shelling out top dollar for games you want to play but not buy new, then I will not be continuing with Xbox and their products. I state how much I spend on new games every year because they stand to lose that income from me. I am not opposed to buying games new, if it’s a game I am really interested in, and my history shows I am willing to do this. If this is the course they are planning is to apply a used game tax of some sort, expect their sales to be low. I understand that markets change and evolved, but the choice of the consumer will always prevail in capitalist societies. Do not burn a group of gamers who have been gaming since the 80’s, you can turn us off and never get us back again. I know they really think this is a great way to secure profits (which are a good thing) but what they are going to get is a large investment in a new product line which is not going to pay off. Certainly someone important in the Microsoft hierarchy has spoken some words of concern, listen to them.

@gobluebuckeye I am a big fan of Xbox and even i have the ps3 60 gig version only played in it killzone 3, gran turismo 5 , the god of war serie and uncharted, all the other games i´ve played were on xbox, i love the controller and love the fact that i can purchase used games and lend the games to my friend, please lets START a WEB PAGE with signatures from all over the world to let know microsoft tha we are not going to buy their system if they charge that fee maybe that way MICROSOFT WILL HEAR US AS GAMERS!!! Truth is I am a gamer; I have been since I was a child. This chosen activity of mine is not going to stop any time soon. I have been loyal to Microsoft because of the quality of their games and product they put out. I love the achievements system that makes for great competitiveness and identification amongst gamers, and in fact would be the hardest thing for me to give up on. However, I refuse to spend this amount of money on something that will completely change the culture I am accustomed too when it comes to gaming. Gamers like me will spend top dollar for the games that excite them, but we also like to try things out before we buy them, like to trade them in if they suck or just out played. We would not like a product that is ours at a dictated price that has no resell value, and if they charge a tax or fee for replayed games, that is going to effectively end any resell value. I don’t want to give up my Xbox profile and the points I have accumulated, but I will trade it in for trophies that keeps my gaming experience in place, you know the gaming experience I like.

Viper people like us need to let Microsoft know they will lose us, because if enough of us do speak out they will change. Money talks in volumes.

Im not a fanboy only play the games in my xbox because... well i liked the controller better and the unit was not as heavy as my PS3 to take it and carry to my friends house, if there is a good game even if it is in Sony, Nintendo, PC or Microsoft i will do my best for playing it regardless of the plataform, but as i said always liked microsoft controller

It´s a SaD Day for GAmerz not only MS ones.

@arsy130 @aloufika I am an XBox fan but not an XBox fan boy as I don't go on about it. I simply went with the machine that was all round the best of the last generation. That's it. I was a fan of what was done.

Not this time round. Sony ate humble pie and got it right and M$ messed up. Guess what I will be buying. A PC! No that's a joke. I already have a gaming rig. I will be buying PS4. They did everything right like XBox did previously.

The big problem with this is that MS has not offered anything to repay costumers for the limits it's going to impose on how they use their rightfully purchased software. Steam offered PC gamers a trade in that they get frequently excellent deals on games just a few months old with lots of good community and mod support integrated into the system in exchange for not really having a way to sell used games; Microsoft isn't promising lower prices, free DLC, or mod support to make up for the further constraining the ecosystem and inconveniencing it's costumers.

This. PC gamers haven't had a used market in a long time, but it's ok when you can scoop up a digital copy of that game for possibly as low as $5 on sale in a few months or so. The market is very dynamic; very fluid, on Steam . Why would you buy used when you can own a 'new' digital game with full multiplayer features for less than used prices? The drawback is, you can't offload those games for a new release if you are short on cash---but for what is generally charged for games on Steam (with a measure of patience) and the amount of continual multiplayer you can get out of the games on PC, the value is immense.

I use to loathe the idea of Steam especially at the install of HL2 (til I discovered offline mode), but between sales, mods, Steam servers, friends and party text/voice; I'm perfectly fine with paying less for games on the Steam market (as in, no service fee) and having all the essential 'Premium' functions of any socially-connected gaming console. It's a fair trade-off for lack of used games, and that's coming from someone who definitely likes being able to trade in old unplayed games for the newest interest.

@johnyogi @DarkRaven0021 Yeah but what if I bring it to a friend's house, log into my account to play & when I want to go home, let's say he asks "can I borrow your game for the night." Does that mean he has to stay logged into my account just to play the game? What if I went home that same night and wanted to play a different game, while he's still playing on my account? Would I be able to log in? Because if not that sux BIG TIME! To many potential restrictions. We'll have to wait and see.
