All that free speech stuff. First amendment, blahhh. Anyways, the sheriff said on the news today he ran the book and the case through one of Florida's top prosecutors, and had his warrant signed by a circuit judge. I realize everyone here is a law major, but that's several people, all with great knowledge of the law, that agreed the sheriff has a case. And that is why his scary ass is now in Florida. Go Polk County! :)

Actually they only agreed that there's enough to bring that person in. A grand jury decides if there's a case.

it'll go to trial because a grand jury would indite a ham sandwich. Thats all due to the incredibly biased nature of grand jury proceedings.

Also after reading that this guy only has a public defender I'm starting to get scared that this will set a scary precedent. Hopefully I'm wrong and the right verdict will come out but I'm not holding my breath.

- Not necessarily (I've served on a few grand juries).

- That is scary. I'm hoping he only has a public defender because he hasn't found an attorney in Florida yet.

I don't agree with what they're saying. I'm holding to the principal of the 1st Amendment. Again, freedom of speech means having to tolerate speech we don't like.

Yes, you said that and I understand that part, but tolerance and agreement are two different things. I don't agree with what he did and I'm also not the one who is charging him with a crime.

I do not agree with what he says but I agree with free speech. Thus I would defend his, and by extension my own right to free speech.

Being weird and creepy isn't a crime. Any retailer can choose not to sell the book if they don't like it, but to arrest him? That's a first ammendment violation.
