I don't think it should be absolutely required, but I see a lot of wisdom in it. Of course, if a moderator is moderating from the queue, it can be near impossible to stick to your own boards. In those instances, you just have to be as thorough in investigating the context as possible.

My answer to the original topic: no. However, I do feel that people do misinterpret the roles of mods and admins.
A moderator is simply that, a moderator. They step in to take control of a situation that they see is potentially disruptive. Gamespot.com is a business, and it is funded by profit and revenue. A completely legitimate business, where-as this forum, although public, is also owned and operated by Cnet.com, and those who register give up certain rights (which is CLEAR to them when they click agree). However, Admins are those who make rules, and set them in stone. It is they who monitor topics and change/update rules based on trends and common complaints prevalent in forums/threads.
I'm a moderator for Gamespy and I understand the frustration of reading completely useless posts over and over, day in and day out when people obviously have no care for those rules in place which are there to maintain order. That is why a ToS is needed, especially in a place where everyone is anon, and those who do voice their opinions are free from any consequence. If Johnny A goes out of his way to annoy and piss off Johnny B, then there needs someone to step in with the power to uphold the rules of the forum. It's simple. If you don't agree, then Gamespot offers an "ask the mods" board where you have the RIGHT to bring your complaint forward. I don't see anything wrong with that. This is not a free board - someone had to build it, code it and pay for it. It's not yours, it's not mine - it belongs to Cnet.com. The moderators volunteer to do their part and help clean up the "does my cat sneeze because..." threads that pop up out of pure boredom.
I love gamespot, it's a nice place to relax and know that if someone trys to start trouble, they'll get warned/moded. Nice system. Can't fix what's not broken.
I'm going to go out on a limp here and say...deal with it.
You can't do anything about it, and usually when you try - you end up being punished further. Just try not to repeat mistakes, learn from the past. If one is modded for one thing, one does not do it again. Being modded a few times won't kill you...and if you're banned or suspended, you probably deserved it.
Focus on being more careful, not on complaining about things that are out of your hands - for the most part.

Gamespot is constantly locking threads and moderating people for very minor things. Often I see a thread locked for no reason whatsoever. Frankly i'm also a bit tired about being moderated just for voiceing my opinion about the moderaters. kingyotoX
They have always been like this, but I have to say, since the whole Gerstmann conspiracy, I think this site has become just a little less Nazi-ish.

Remember, there are plenty of us that lurk and read everything :P I used to post a lot round here, but my interest was lost when the same topics kept getting made over and over again. I still read the more interesting topics though and post once in a while :)
And why should we even value your opinion...? :Pnot too strict..the rules are too vague though and the mods interpret them poorly......

As others have said, the ToS isn't concrete. There is too much left to interpretation.
I personally think that it is too strict in certain areas, and not strict enough in others.
