When you divorce no one gets anything. There is also no more benefits to marriage.

The problem here seems to lie in how marriage is dealt with. How your belongings get rationed off to someone else. Not really that the person cheated.

And exactly what are is the government going to do to you? They already get involved in divorces. Are they going to jail the guilty party? Our prisons are full enough without adding in more "criminals" who've done no real crime.

Well it would probably discourage marriage and ensure people think through whether or not they're ready to make their relationship legally binding. Still don't think it's a good idea though. All is fair in love and war as they say…

How would one prove a spouse is cheating? You can't just go to a cop and say "My husband cheated on me. I know it."

Considering the amount of cheating that goes on, there would be alot of trials in courts about this.

I'm sorry but having the government arrest people for cheating/fining them is just a bad idea. It strains government resources, discourages marriages, overfills prisons with non-criminals...

The only real reason I see for it is petty revenge. And the law isn't ones personal vengeance machine.

It should not be illegal to cheat on your spouse. Imposing morality is pointless, morals are just semantics. Outlawing things should be kept in the realm of pure logic, without emotion. Well, as logical as stupid fleshy apes can manage.

Outlawing extramarital affairs also heads towards the direction of not admitting that we're stupid fleshy apes with stupid fleshy ape instincts. It's like condemning teen pregnancy, or saying "Everyone can be a leader." It's not fixing anything, it's just resisting the immovable wall of human stupidity.

If anything, I think marriage should be illegal. That seems to be where all the financial entanglement and woes seems to start anyway. And besides, I thought capitalists were all about self-support. Marriage is for pink commies. Get rid of it.

Adultery IS in fact illegal in some states, it's on the books just not enforced. But again-- it already is illegal in some parts and if you had no idea it was that just goes to show how seriously it's taken.

I don't like the idea of someone providing support to an ex-spouse in general, unless they're the guilty cheater. :P
