I'm pretty sure it's not illegal to cheat on your spouse in the U.S. at least not in California.

It should be illegal and you should have the right to divorce without giving up half of your things. Maybe something like that but really it should be illegal, agree?

I think in the U.S. adultery is illegal only in some states, it's just never enforced.

Should we then make it illegal to commit the unhealthy (in terms of relationships) practices that experts tell us typically lead to cheating?

I don't know what making it illegal would do. People would still do it. If you marry somebody with the same morals you do you won't have that problem, from my experience.

No. Cheating means you don't want to be in a relationship. If you don't want to be in one end it. Cheating is like breaking a contract.

Divorces take time. I'm anti-cheating, so I'm just saying. I think a lot of people who would want cheating to be illegal wouldn't like a lot of the things that it may entail. I, for one, don't think the government should have any say in the inner workings of private relationships.

No, it shouldn't be. It's not the government's place to tell me I can't sleep with someone else because I'm married. That's just ridiculous.

well I think if the majority of people wants to make cheating illegal. go the **** ahead. but I think it would not be in the states interest to make it less desirable to marry someone and start a family unit. after all that is what pretty much drives a nation.

No. That is a terrible idea.

The government should have no say in my love life. Also wouldn't swingers thus be breaking the law even though it's agreed upon beforehand?

No. The government has no place in this.

No. Getting divorced is bad enough. If you didn't sign a pre-nup in California, the male spouse has to give 50% of his earnings to his ex-wife, that's bad enough to stop guys from cheating.

Adultery hurts your spouse, your wallet and your children. It is a selfish act based purely on lust. It doesn't mean the offender would get stoned, but I know a friend of mine who's married told me that it would suck if she finds out her husband is cheating on her.

So when someone gets cheated on, they should just deal with it? Get a divorce, I would, then lose half of their belongings to someone who deserves nothing?

I guess I feel like the government shouldn't be involved but there should be some punishment for a spouse cheating.

Just one Punch.

The government has no right to tell me who I can/can't have sex with (within certain parameters, of course. The person in question must be willing, and of legal age), and when I'm allowed/not allowed to have sex. Letting the government control our love lives is insane.

Why should the government have a say in people's relationships? Unless it's for legality or property issues, they should have no role.

How about this.

When you divorce no one gets anything. There is also no more benefits to marriage.

The problem here seems to lie in how marriage is dealt with. How your belongings get rationed off to someone else. Not really that the person cheated.

And exactly what are is the government going to do to you? They already get involved in divorces. Are they going to jail the guilty party? Our prisons are full enough without adding in more "criminals" who've done no real crime.

Well it would probably discourage marriage and ensure people think through whether or not they're ready to make their relationship legally binding. Still don't think it's a good idea though. All is fair in love and war as they say…

I agree that it is horrible. I don't think making it Illegal will do anything though, maybe you shouldn't have to give up your possessions to the Cheater, it should be the opposite. The Cheater gives you 75% of their possessions :)

The government shouldn't be involved in marriage at all, in my opinion. It should give no benefits.

How would one prove a spouse is cheating? You can't just go to a cop and say "My husband cheated on me. I know it."

Considering the amount of cheating that goes on, there would be alot of trials in courts about this.

I'm sorry but having the government arrest people for cheating/fining them is just a bad idea. It strains government resources, discourages marriages, overfills prisons with non-criminals...

The only real reason I see for it is petty revenge. And the law isn't ones personal vengeance machine.

Okay. But you have to prove in a court of law that they were cheating. And that can be costly and time consuming for both parties.

Ok how about this, and once again I'm saying that YOU WOULD NOT GO TO JAIL!

But instead of it being illegal, you should be allowed to sue your spouse if they cheated on you, and you must provide evidence. Is that better, suing someone is like revenge, if you win, it would make up for the costs of the divorce. More reasonable?

Whether you agree with it or not, the military has adultery on the books.

You can be jailed for up to two years, which would result in being branded as a felon.

It should not be illegal to cheat on your spouse. Imposing morality is pointless, morals are just semantics. Outlawing things should be kept in the realm of pure logic, without emotion. Well, as logical as stupid fleshy apes can manage.

Outlawing extramarital affairs also heads towards the direction of not admitting that we're stupid fleshy apes with stupid fleshy ape instincts. It's like condemning teen pregnancy, or saying "Everyone can be a leader." It's not fixing anything, it's just resisting the immovable wall of human stupidity.

If anything, I think marriage should be illegal. That seems to be where all the financial entanglement and woes seems to start anyway. And besides, I thought capitalists were all about self-support. Marriage is for pink commies. Get rid of it.

Adultery IS in fact illegal in some states, it's on the books just not enforced. But again-- it already is illegal in some parts and if you had no idea it was that just goes to show how seriously it's taken.

I don't like the idea of someone providing support to an ex-spouse in general, unless they're the guilty cheater. :P

Even though I've been married 11 years and have never cheated I strongly disagree. There are enough laws, and what goes on between spouses should stay there, out of the judicial system.
