Seeking to combat rising obesity rates, the New York City Board of Health approved on Thursday a ban on the sale of large sodas and other sugary drinks at restaurants, street carts and movie theaters, enacting the first restriction of its kind in the country. Mayor Michael R. Bloomberg, who proposed the measure, celebrated its passage on Twitter.

NYCs new sugary drink policy is the single biggest step any govt has taken to curb #obesity, he wrote. It will help save lives.

The measure, unless blocked by a judge, will take effect in six months. The health board vote was the only regulatory approval needed to become binding in the city, but the American soft-drink industry has strongly opposed the plan and vowed this week to try to fight the measure by other means, possibly in the courts.

This is not the end, Eliot Hoff, a spokesman for New Yorkers for Beverage Choices, an industry-financed group opposed to the soda sales restrictions, said in an e-mail moments after the vote. We are exploring legal options, and all other avenues available to us. The plan is a marquee initiative of the Bloomberg administration, which is known for introducing ambitious and, some say, overreaching public health policies, including a ban on smoking in bars and the posting of calorie counts on chain restaurant menus.

The soda measure would bar the sale of sweetened drinks in containers larger than 16 ounces, smaller than the size of a common soda bottle. It would affect a range of popular sweetened beverages, including energy drinks, presweetened iced teas and common brands of nondiet soda.

The restrictions would not affect fruit juices, dairy-based drinks like milkshakes, or alcoholic beverages; no-calorie diet sodas would not be affected, but establishments with self-service drink fountains, like many fast-food restaurants, would not be allowed to stock cups larger than 16 ounces.

Only establishments that receive inspection grades from the health department would have to obey the rules, a group that includes movie theaters and stadium concession stands. Convenience stores, including 7-Eleven and its king-size Big Gulp drinks, would be exempt, along with vending machines and some newsstands.

Mr. Bloomberg has said the plan does not limit consumers choices, since customers can still purchase as many 16-ounce drinks as they would like. The soft-drink industry, which has spent more $1 million on a public-relations campaign opposing the plan, argues that the policy restricts consumers freedom to buy beverages as they see fit.

Six in 10 residents said they thought the plan was a bad idea in a recent poll by The New York Times. But the measure easily earned the approval of the health board, whose members were appointed by the mayor. The board voted eight to zero, with one abstention, to approve the measure just after 11 a.m. Thursday.

Mr. Bloomberg has made curbing obesity a top goal for his administration, citing higher rates of diabetes and fatalities among the citys more overweight neighborhoods. More than half of adult New Yorkers are obese or overweight, according to the citys health department.

Opinion among other city lawmakers is mixed. Several City Council members, including many members of the councils minority caucus, said the plan would adversely affect small businesses, particularly in poorer neighborhoods. A resolution against the plan has been circulated in the City Council, but the speaker, Christine C. Quinn, has not put the measure to a vote.

The plan has generated widespread interest in the topic of obesity and soft drinks. The mayor has been pilloried in some quarters as Nanny Bloomberg, with critics saying the soda plan is another example of social engineering by the government. Supporters, including many prominent academics and scientists who study nutrition, say the policy could help reduce the amount of calories consumed by city residents.

Not really sure what to say. Minor annoyance that can be circumvented by loopholes but apparently some folks here feel strongly about it so have at it!

I think it is the sheer stupidity and presumptuousness of it that people wonder about, but I have no vested interest in it either way since I highly doubt my local government is going to start banning soda any time soon.

Unlike some of CA's policies, this is actually a very good idea. Portion sizes have increased exponentially in the last 40 years, and all that sugar that the public consumes adds up to cause obesity. The sugar industry has a very powerful lobby in the US and UK, which is why measures such as this haven't been attempted before. I'm glad they are doing this.

Basically. The whole point was to make people think about how much we are drinking of the stuff. We are less likely to buy two smaller sodas than one big one.

That's the main thing from all of this. I'm sure most people don't give a hoot about the ounces of soda, but the government imposing on people's lives is...troubling.

Even if i lived in NYC i dont think this is that big a deal. I rarely drink pop anyways but even then most people do not realize how many calories and sugar are in their drink. Sure ice cuts it down a bit but then they just get refill after refill anyways. The only bad thing about is that it takes away a choice that most people should be able to deduce by themselves. I would doubt this will do anything for the common health of the city. Hopefully people would only drink one glass of soda and if they finished it then they would order a water but that is probably not going to happen. For places that charge for refills im sure they will be happy about the ban though and probably more places will start to charge that didnt before.

I think its just not being sold in city limits, but hopefully they also have created a special police unit to conduct raids on suspected dealers.

the funny thing is people in the city seem to generally be a lot fitter than people i've seen elsewhere because you're usually doing a lot of walking...

Only one way to find out.

I dont really care, and I will say that a 16oz bottle of soda is a lot to drink in one sitting. However, why is the gov't trying to fight obesity in the first place. If a person over eats bad food, gets sick and dies, isnt that a product of their own stupidity? If we really want to solve the root problem why not outlaw foolishness. I say let the over weight people get whats coming to them and force them to pay higher premiums on their insurance.

Yes let's all leave our decisions up to the government. It's not like another bottle can't be bought increasing portion size by more than 4 oz.:roll: People that want the government to do their thinking for them disgust me.

Maybe for you. I can down a 20 oz like nothing, but then I drink a lot of liquid (be it soda, juice or water) in general.

I remember awhile ago reading that the military started to take an interest in fighting obesity. I like the idea of a war room full of generals lamenting how fat recruits have gotten these days. :P

The funny thing is, even the 8oz cans are like 2 servings, and make up almost your entire GDA of sugar . But I guess it's a good step to ensure that people don't think that those bottles are safe for a person to drink by themselves
