While I'm not typically a fan of the ACLU, this time I have to give them credit. I can't think of anything that is incriminating on my phone (and no off-color photographs either). However, I have to admit the thought that being pulled over for a broken tail light and having my entire phone scanned creeps me out a little. Any thoughts?

From the Article:

A US Department of Justice test of the CelleBrite UFED used by Michigan police found the device could grab all of the photos and video off of an iPhone within one-and-a-half minutes. The device works with 3000 different phone models and can even defeat password protections.

"Complete extraction of existing, hidden, and deleted phone data, including call history, text messages, contacts, images, and geotags," a CelleBrite brochure explains regarding the device's capabilities. "The Physical Analyzer allows visualization of both existing and deleted locations on Google Earth. In addition, location information from GPS devices and image geotags can be mapped on Google Maps."

The ACLU is concerned that these powerful capabilities are being quietly used to bypass Fourth Amendment protections against unreasonable searches

They have no business going through my phone when they pull me over unless I'm a suspect of dealing drugs or other illegal things.

Not if you don't know they are doing it.. so thats what they do when they sit in their car making you wait when they pull you over. They shouldn't be allowed to have access to your phone, thats an invasion of privacy. It's well beyond a joke how much power the police have over people. Our rights are dwindling down every day.

The ACLU is obviously correct that regular use of such a device during traffic stops would be unconstitutional. Of course, apparently they lack evidence that Michigan police have actually deployed the device. In turn, that's a good reason for their disclosure request.

My Atrix has a fingerprint scanner, I wonder if it can break through that? Either way, there's absolutely no way I'm handing my cell phone over for any reason. And another thing, How would they even know you had a phone on you unless they did a search?

Im usually on the side of the police on most things but you are right on this one. If im not a convicted felon or convicted of anything then there should be no reason to go through my cell phone for simple traffic violation. Im sure they have regulations stating something like this anyway

Then I suppose they have to start doing searches. In my country it was decided last week that police can do random searches in any area designated as being worth it, by the local mayors.

Agreed. I also hate how people think the police are out to F them. I cant tell you how many times ive been pulled over for speeding or doing something wrong and just by simply being nice, honest, and polite to the officer he/she would let me go scott free.

They have to do that at some point. I'm not against them knowing what people have in their cellphones. Actually I want them to know every word we say.

How are we going to provide security once we all get the technology and potential to destroy this earth? We are going to need the police to know who you talk to and about what, even when you're not using a phone.
They are going to do that, the only alternative is to stop all advance in science and wealth in the upcoming decades, and only make the specialists transparent. That isn't going to happen as we all love money.

Privacy is very short lived. We didn't know of privacy in the middle ages and now it is going to disappear again. We need people to become 100% transparent in the upcoming decades, and we need better software to find dangerous information. And among people are the governments.

I don't know how this goes in the USA but I would be a bit careful with probable cause. When I place two fingers in my pocket they have probable cause. If I want to complain about the search I can do it after the procedure. If I don't want to be listed as a troublemaker I can stay anonymous, but then I can't file a complaint. If I do file a complaint they wipe their ass with it.

i recall seeing an interview where he said he was an officer of some sorts. this was a few years back and it was a youtube vid where he was talking about idiots that send him death threats as it is a federal offence to threaten an officer of the law and how he holds some title. sorry i dont have more details or a link.

Some people wish to preserve the constitution and giving the government more and more power over it's people is a step in the wrong direction. Yeah, I remember the interview I beleive he was a volunteer Deputy Sheriff in Michigan. Though He doesn't live in Michigan anymore, so I'm not sure if he still is.

Do they have a warrant? No? Then it's illegal.

This reminded me of the case where the Supreme Court struck down the the tactic to use thermal imaging to spot out people growing marijuana. They didnt have a warrant.

Not really related, but for some reason that came to memory.

Yes, because the Michigan STATE "STATE" Police having an extra tool to aid them in crime prevention/solving is the federal government trampling your constitutional rights... Tell me now, where in the constitution does it say we have a right to not have our cellphones and/or other wireless devices searched? Oh, there is a clause about privacy? Oh, but then there is a clause on that clause about warrants? Oh, and the police need a warrant to use this device on someone's phone... OH, so it is exactly the same as warrants to search property. Only now it is to search wireless devices.

I have sort of conflicting thoughts on this whole thing. On the one hand, like I said before, there is nothing for me to hide on my phone, so scan away.

On the other hand, I know that they 'claim' that these types of searches will not be done without a warrant, but it reminds me of what happens towards the end of every month here in NY. Mayor Bloomberg (and those before him) and big-shots in the police department say that they don't and never have had ticket quotas. But the last few days of every single month there is an obvious ticket blitz. When I worked in Douglaston, I literally would watch as tickets were placed on 100% of the cars on the street (regardless of wheter or not the meter was up). I'm guessing they figured enough people wouldn't bother to fight it so it is worth it. Anyway, the point is, I'm always a little leery of what law enforcemnets official/public policy is compared to what is actually done.

Haha, he does make a point. But Buttons, if you're worried about mental territory or status, you get all the room you need to make your point, so there is no need to worry about that. And when you rationalize you obtain more status in the long run than by appearing dominant, when it comes to an internet forum. Yes there is still one barrier left and it is the warrant that they need. Still people should stay on their toes when they think of these laws, right? Or should we just let everyone do what they want and open the curtains in a few years time or so? What the others are saying isn't entirely without merit.

Being that you are driving on a public road and driving is a privilege you have given implied consent for some things. This is evident for drunk driving. You have to submit to a field sobriety test if thought to be driving drunk or you have to submit to a breath, blood or urine test. Failure to do so can result in suspension of your driving privileges. Now, I don't think one should have their phone scanned just for the hell of it, but if you as a driver have a wreck, your phone should be subjected to search to see if you were distracted by being in the middle of a call or texting at the time.

There should be no reason for the cops to just download your phones contents if you are just walking down the street minding your own business, but if you are picked up for some reason or stopped under suspicion of another crime, reasonable cause comes into play and to gain evidence, your phone could be searched under that premise.

I wouldn't give my phone to the police if they stopped me even though I hardly have anything on my phone apart from people's phone numbers.

It seems to me, you're the only one in this thread who's "up in arms". Some people wish to preserve the constitution and giving the government more and more power over it's people is a step in the wrong direction. I have nothing on my phone to hide, but that's not the point, it's about exercising my constitutional rights, because if you don't get "all up in arms", your rights will more likely be trampeled on.

Yes, because the Michigan STATE "STATE" Police having an extra tool to aid them in crime prevention/solving is the federal government trampling your constitutional rights... Tell me now, where in the constitution does it say we have a right to not have our cellphones and/or other wireless devices searched? Oh, there is a clause about privacy? Oh, but then there is a clause on that clause about warrants? Oh, and the police need a warrant to use this device on someone's phone... OH, so it is exactly the same as warrants to search property. Only now it is to search wireless devices.

You say that as if the government doesn't abuse it's powers:roll: Which is what I was getting at, the more civilian spy err, crime fighting tools you hand them the more power they possess to use to benefit a cause. Take a look at the TSA, I find it amusing that the Department Of Homeland Security is behind both the TSA and electronic searches of cellphones.

The question isn't supposed to be asked in the first place because it is nobodies business. The sentence 'if you've got nothing to hide you've got nothing to fear' is a very old mental trick. The person stating it always has things to hide, and demands that you don't, because you are 'lesser'. Hence the word 'fear'.

I just think it'll create more problems by refusing. If someone of the law requests to look at something then it doesn't look good if you refuse, it just makes you look guilty of something. So much easier (and quicker) to just them look and move on.
