I'd say yes because although she did come back to life, you still began the act while she was deceased and had no preconceived notions that anything like that would transpire. To sum it up, you wanted to do it with a dead woman, you began doing it with a dead woman, so therefore x=necrophilia.

Here's a point – there's a few places where there isn't a law in place against necrophilia. If that were the case, could you be tried for rape if you instigated the act whilst the person was dead, thus not actually intending to rape?

I've a seeking suspicion that there isn't actually a law against necrophilia in the states (or certain countries at least, although I could be wrong).

Presumably you could argue in the court of law that what you were doing is perfectly legal and how were you to know the person would suddenly wake up? It wasn't your fault she didn't remain dead after all.

And when she woke up you stopped immediately, because copulating with the living really isn't your cup of tea.
