Smoking in the street can give other people 2nd hand smoke, drinking doesnt effect anyone else.

Beats me. Maybe something to do with intoxicating substances in particular? Incidentally, most European countries have banned smoking in many public places. In England, it's probably legal to drink in more public places than it is to smoke.

Smoking doesn't bring on the same problems that drinking does plus many people throw their bottles when they are done with them which can be hazardous and cause significant damage.

there is no rhyme or reason why any of the laws are in place.. cannibus is illigal and liquor isnt, ciggs being the most detramental to your health are the easiest to aquire.. everything is bass akwards. the govt doesnt actually care about your health.. they just care about making money :-/.

that being said i dont see the need to drink in public anyway, but if you have too many drinks who knows what youll do.. if you have too many ciggs you will most likley just puke and get over it.

Times I have been in places that did allow public drinking there seemed to always be one, if not several, passed out drunk guys on the sidewalk. It may not effect anyone else (unless you are driving or something), but not allowing drinking in public certainly does help the drunk's public image.

I don't want crazy drunk people on streets saying weird stuff.

I hope they ban public smoking too. That stuff is annoying as hell.

Most places they consider it public intoxication but I believe that if you have it in a paper bag they tend to not care. I know when I lived in Las Vegas you could be on the strip and drink and get drunk as hell on the strip and no one really cared. Hell you can smoke weed on the strip and not get stopped or at least I never was stopped

Drinking Impairs the user making them unfit to wonder around in public... smoking doesn't... Walking past someone smoking isn't going to hurt you. Sorry I know people like to complain and hate on smokers, but unless you stand around with them every time the smoke nothing is going to happen to you...

I believe it's less to do with drunk and disorderly behaviour and more to do with charging someone with a crime. For instance, before the open container laws (I may be mistake, so correct me if I am wrong) it was actually legal to drink and drive. The catch was that you had to maintain a blood-alcohol level below 0.07.

Open container says that regardless or not if you're drunk, you're still drinking.

Bringing it out on the streets means that people who "may soon be drunk" but aren't yet can be charged with a crime; and that those who leave unattended containers (thereby giving minors access to alcohol) can also be charged for their negligence.

Eitherway, the point is to give the police the ability to charge you before you commit a crime due to the likelihood a crime will be committed.

I don't know what type of smokers you've seen... If your a random stranger getting in there face for something no one likes that. why would smokers be any different. But, most of the time when someone tries to bum one from me I'll either give them one or say I'm out (I only say I'm out if its the last one I have I can't get another pack for a long time after that)

I can understand complaining about smokers in enclosed spaces but this idea that you are inhaling enough second hand smoke to harm yourself being outside in public is ludicrous. Smoke rises and typically unless you are standing right next to the person smoking you are in no danger of breathing in the dreaded second hand smoke *cowers in fear

I hate the smell of some perfumes but you don't see me trying to call for a ban on them. You learn to deal since people have free will. You are free to walk away from the smoker in most cases

I like the smell of a ciggie but since quitting I hate the smell of someone who has just come inside from having a ciggie. The smell seems to be worse when it is cold.

Making them illegal isn't ridiculous at all. How they're even legal is what bothers me. They're just sticks packed with all kinds of disgusting chemicals that get you addicted to a habbit that does nothing but harm you and others around you. By all rights they should be illegal.

That is far from the truth. Cigarettes have positives. Just because you don't think it's worth it doesn't mean nobody should smoke just because you don't. Cigarettes won't kill me. Even if they did, it's none of your business, really.

Really, cigarettes have positives? Please do tell, I'd be interested to hear your idea of "positive".

They're a dangerous concoction of chemicals, marketted in such a way to attract young and impressionable people in addition to keeping the older smokers hooked. I fail to see how breathing in all those potentially deadly toxins can produce beneficial, positive results. I also fail to see how they could possibly be legal...

Oh wait, the government taxes the industry and makes and absolute fortune - nevermind.
