I guess people get desprate for money. But this. Everyone knows there is a chance of the Rrob and they even a have a replacement plan and you get a free xbox back why sue.chaoz-king

It amazes me how much Microsoft consumers delude themselves into thinking they got a fair deal when they bought an Xbox.

At least this will stymie the constant kneejerk of 'Microsoft did no wrong since they were never sued.'

umm, the fact that the lawsuit comes two years AFTER MS addressed the issue, while the DRE problems were never admitted to and nothing was done until AFTER they were sued.

I had already posted this, but apparently you have problems with deductive reasoning and reading comprehension so I posted it again. Unless you want to say that PS2 owners didn't get a fair deal too?

As a last point, MS hasn't LOST their lawsuit nor settled it, AND DID SOMETHING ABOUT THE PROBLEM 2 YEARS BEFORE SOMEBODY TRIED TO SUE. Are you REALLY this thick? Or just that completely biased?

I know that,but won't the three year waranty be over for many launch owners? since the system will be reaching it's third year later in November?

It really isn't enough. If you only want to play 360 games for the next three years, then fine, but what happens 10 years from now when you want to play bioshock on your 360? I think if you take good care of your consoles then they should last forever. This lets me turn on my old NES and play battletoads whenever I want. I also just played my old lost vikings game on my PS1. People won't be able to play any of their old games on the 360, and that is sad.

How have they fixed the problem and when have they announced a fix. So far MS won't even confirm what the problem is, all we have is speculation about what the problem is and when they come out with smaller chips which every console does to save in development costs all we have is more speculation about how its going to fix the problem. They said the Jasper would do it, then the Elite yet I havent seen a difference.

When MS finally solves the problem we will know it because MS will make sure to advertise it. There is no room for humble in this buisness and all these companies brag about every significant and insignificant achievement.

Yes and no MS employee or representative has claimed it was or does resolve the RROD issue. Only random online sites and analysts. People only guess, remember when the Elite was suppose to fix the RROD issue.

Finally. I don't know a single gamer whos xbox hasn't RROD'ed. Not only once, but twice!!!! Microsoft hasn't even fixed the problem though!!!!! They only put band aid's on it (warranty). I would sue for gaming time lost, I can't play uno if my xbox is being replaced (with another broken xbox)

That wont happen, civil suits are never tried solely based in the original evidence. Anything in the original filing is mostly to show the judge that the suit is not firvilous and allow it to go through. Before the trial MS will be froced to turn over any evidence partaining to the case and if they refuse or destroy anything they will be tried for obstruction of justice. If anything this could finally force MS to reveal the real failure rate.

This was inevitable......not a coincidence that the 3 year warranty is almost up for a LOT of people.

I'm actually suprised it took this long.....it's like people thought it wasn't a problem because MS decides to go on a PR campaign to say they will pay for the problems (which ended up NOT being true)

actually I do believe they can be sued. You see Sony was sued (successfully I might add) because of faulty disc drives. What most people still don't realize is the disc drive failures were a HUGE part of the problem with X360....which btw wasn't covered under supposed warranty to rectify the bad situation. Not only that they had a lot of hardrive failures as well...which again not covered under their warranty.

Keep in mind the three year warranty will run out this November for launch consoles.....seeing as most have to continually get a refurb because of RROD.....my guess you are soon going to have a lot of pissed off people when MS says their warranty has run out.

I Personally don't know, it matters if MS renews the 3 year warranty every time you have to send the console in, and if MS continues the 3 year warranty past November.

No they didn't have massive hard drive failures or disc drive problems. They had maybe 1-3% problems which is by far acceptable in manufacturing. The real problem is RROD which is why they extended the warranty to 3 years. Sony is the company that had MAJOR DRE problems as well as power supply issues. Only difference was Sony DIDN'T fix the problem unless you paid them. I had to buy 2 PS1's and 2 PS2's yet I haven't had to spend a dime getting my 360's replaced. I'm currently on my 3rd 360 and frankly it doesn't bother me. It didn't cost a dime and I got a new 360 each time.

IMO sueing for something that doesn't cost the consumer a dime is frivolous and a waste of time. The suit should be thrown out of court and the people sueing should have to fork over any court and lawyer fees.

i know that it will not happen

if they go bankrupt from that, they well deserved it and i will be glad. ive been gaming for a long time, and i never had as much problems with one company as i did with microsoft... compared to all my other problems i had with them, the RROD is not that big of a deal(for me)

Not the only problem. Scratched discs because of disc tray failure is another. The way I see it is, yes MS has addressed the problem after they knowlingl sold a hardware prone to failure, and at first did nothing to fix the customers' complaints. It went the route of Sony with the ps2, denying everything, then MS wisened up and provided the 3 year warranty.

A clasaction law suit is to protect the counsumers (read: make the lawyers rich) from a company that knowingly continued to make faulty consoles without truly addressing the failures, but instead provided customers a warranty that exhanged your faulty unit for a refurbished one. Can you see this occuring say, in the automonile industry? People buying brand new expensive BMW's that are prone to failure. Oh wait, BMW will repalce your brand new car with a refurbished (read old, scracthed up car) that runs better, but may also fail again, and you get to go through the whole cycle again....Get it no.

I really would love to get a 360, but refuse to buy a console that may eventually fail. Too big a risk! Also the Jasper chipsets have not been proven to eliminate the fail rate. I may have to give in though, since I want Gears of war 1, anbd 2 looks good. Also depending on how Alan Wake pans out! This looks like a very promising title. We'll see!

well my mate just got hes xbox 360 from repairs ( he got the error e74) and now he just got another issue the disc drive problem. lol seriously that sucks .

justice for what? they cover the system for 3 full years for RRoD. You don't even pay to ship it to them. What's there to REALLY be erked about? I've sent mine in three times and I for one am EXTREMELY happy that they at least owned up to the problem. This lawsuit will go absolutely nowhere just like the Nebraska Senator who filed a suit against God. :lol:

Both lawsuits were thrown out. This case is pointless due to lack of evidence. Do you people honostly think a blog site and an internet news site are viable sources? This suit is a joke and proves the state of California is desperate for money.

Cows are just bitter because they live in denial that Sony did anyhting wrong after they lost ther lawsuit and now want to try to drag MS to Sony's level anytime an obvious frivilous lawsuit comes up. Try again...

Its not enough if you loose your launch xbox360 this winter. Then you still loose 200$.

Basicly they knew the box was faulty and they didnt share this fact with their consumers. That is like mayor banks decieving low income consumers too take expensive loans they cant possibly afford.. That might even crash the global economy in the end.. Oh wait it did.

Its not enough if you loose your launch xbox360 this winter. Then you still loose 200$.

Yes we all know, cows wish MS would lose because their company lost a lawsuit and cows just can't accept it. You think maybe Sony could start thinking about the consumer also?

Exactly. People may be saying that MS is doing all these things to correct the problem...with extended warrenties and the sort...but that doens't solve the problme, it just avoids it. If MS knew about the problems, and there has been several articles stating they did, they should be sued for it. No company has the right to knowingly release a faulty product, and if they do , any and all profits gained from said product should be lost. MS has done nothing to fix this problem, except give people other faulty consoles.
