Also, it looks like even in 2D mode it can only display 400x240 resolution. The reason why I say this is because, of course, the 3D effect can be turned on and off - but if a game is designed around the 3D effect, for 400x240 resolution, it would like horrendously ugly at 800x240 due to stretching. Also, the proportions of the 3DS aren't correct for 800x240 resolution. The width of the screen looks like it is about 1.6-1.7 times the size of the height; which matches up exactly with 400x240 resolution. So I'd guess the 3DS is permanently locked in to 400x240.

That assumes the developers limit themselves to "square" pixels. In theory a pixel can be any number of shapes. (Well, depending also on how the screen is designed)
