My results are in line with yours, http://3dmark.com/3dm11/1320752 Since I score lower than you and don't have the FPS issues in BFBC2. My only thought is your lack of ram is hurting your performance in those games.
My only thought is that you may be bottle necked by your ram. Your ram is DDR2-667 instead of DDR2-800 so you're losing some performance there. Secondly, more modern games benefit from more ram so maybe replacing your ram with 4-8GB of DDR2-800 will improve your performance. I've got almost the same system as your Q6600 with a 5850 so I'm going to run 3Dmark and post my results for comparisons.
After watching the five training videos, I went to Direct2Drive and preorder the game for 37.46. Got to love getting 25% off a game. The game looks great, Splash Damage should be commended for the unique art style, very French sci-fi comic.
I hope it get a solid community behind it.

I debated picking it up, but have since found out that it has the new Ubisoft DRM. So I think I will now pass on the game.

Well at least that means my current computer will run the game just fine.
Steam version all the way, just get in on a three pack and get Bioshock 1 and 2 for less than 35 bucks.
The Steam system Reqs, say HD3xxx or higher... seems at one point the game said R8xx or better. But I think that was a mistake and the game does need a SM3 video card.
Plants vs. Zombies, Defense Grid, Dawn of War II, the two Shadow Grounds games. These games all have demos so check them out.
