I had the same problem until I realized that you need xboxlive to download the backwards compatible patch or go to xbox.com. Then select "Support" and on the drop down "system use". Next select the 360 icon and then "backwards compatibility".

You can download the patch onto a CD if you don't have xboxlive and put it in your 360 and presto: Backwards Compatibility!
