It supposedly goes to "sleep" but is always listening... just not recording... If it "hears" a keyword or something that "wakes it up" it begins recording again.

This is exactly what will happen... Microsoft will see they are still losing money and they will eventually patch out some of the crap policies because the "fans requested it." (roll eyes)
