How would he being accepting the sundae though? (It was a sundae; not a cupcake! :P) He purposefully chose not to take it when (I'll add to it) I worked really hard to make it for them, so then how would he be "accepting" it?

battlefront23
Ahh my bad about the cupcakes.. guess what I'm thinking of right now. :P
Anyway, the rights are the sundae, and he is using the rights that he was given. The right not to stand if he doesn't want to.
So if he is using the rights he was issued, then that means he took the sundae. See?

I dont understand why a lot dont get the point. Someone in that class will take a hit on their grade and it has nothing to do with school work. Thats a huge problem.

The TC didn't want this fight. He was pushed, she kept pushing him, wouldn't leave him alone. Everyman has a breaking point, all he wanted was to be left alone.

They should have left him alone, now they pushed him too far, one war against one woman, a one man war.

Hoobinator

Tell me thats not Rambo First Blood Part 1..........

And anyways, No she cant do that.

A students grade is the reflection of whether or not he is fullfilling the course goals, not wether he can stand up real fast.

Thats like your math teacher telling you to jump up and down or youll lose points. And last time I checked we still lived in a free society, as long as people stand up for those rights.

And I want, What TC wants, and every other guy, who came here, and sat in a desk, and did his homework, and listened to his teacher, wants! For our school to love us as much as we sometimes love it!

But yes, I suppose you should talk to the principal or VP or whoevers in charge if you feel it is becoming too unfair.

I had a teacher who put me in ISS because I came to school late when there was a really bad wreck on the road. And when I told her that I couldnt have gotten to school on time BC of the wreck, she said "Well you should have been prepared"

Oh right, Im sorry, I should have been prepared for some guy to try and pass someone else and have someone smash into him and kill him, I wasnt really worried about getting to school at the time, just that a guy had friggen died in front of us, and it could have been me that died. But no, I guess I shoulda looked in my Crystal Ball or used the Force and been prepared!

There's an argument with substance! So you're using fear to get me to stand up? Fear of being a "traitor" Our founding fathers were "traitors" too.

No not fear. If you are afraid that is your own perogative. I am just pointing out the truth.

No.. I can't really translate the rest of it into the sundae analogy..
To him, he is not disrespecting the people who fought for his freedom. The circumstances are different..
Additionally, the flag doesn't mean the same thing to everyone. Maybe some people think that the flag stands for the corrupt government or something.. who knows.. Others might choose to respect the soldiers in other ways.
Disrespecting the people who fought for your rights would be allowing others to take away the rights that those men died for.. you see the difference here? That's when you're grabbing the sundae and slamming it on the floor, and that's when things get disrespectful.

Standing up during the pledge simply shows respect, you don't have to actually pledge by putting your hand over your heart or reciting.

Ok in my Tech class, I have this teacher who if you're the last person to stand up during the pledge of allegiance or don't stand up at all, she deducts points from your grade. I think that's absolutely assinine because first off it's a class of mostly seniors (12th grade), and because where does it say that we have to pledge.

Next time I'm in her class I'm not standing up at all (it's required to graduate so that's why I haven't been messing with her) and if she takes points off my grade I'll report her if I can.

This isn't the only time I've seen an overly patriotic teacher impose the pledge on students and I'm sure some of you OTers have seen it too. So can she do this? All comments and discussion welcome.

That teacher is just trying to instill some discipline in you. As well as trying to teach you all to have at least some amount of respect for our flag. Instead of trying to be a troublemaker, why not just stand for the minute or so it takes to recite it (you don't even have to say it, just stand up). It's not like it's going to kill you.elblanquito_81

Me too. OT reminds me of that fact most days. I think schoolchildren pledging allegience to flags every day is reminiscent of a totalitarian regime.

Yup she probably views it as her classroom and she requires it for her class. I hope she denys deducting points to the principal, then fails him and makes up some other bs excuse. If i was the teacher I'd give a writing assignment with the topic of all the beneficial things that america has done, and make it worth half his grade.

Actually, if you took it to the courts you could argue the de facto segregation for an action protected by the constitution. That was another court case.... *fishes around in his law books* I can't find the specific case off the top of my head but teachers are not allowed to remove students from class for these types of things.

Agreed. Logic games are illogical. You'll do nothing of the kind in law school or ever again in real life, probably. The LSAT proponents can take their "predictors of performance" argument and shove it.

I didn't have her class today, but was talking with some friends on the issue. Apparently you don't have to pledge but you do have to stand up (for some reason) and signing the student code of conduct in the beginning of the year basically yields most of your rights (freedom of speech for example).

I actually do not think what the teacher is doing is that big of a deal. Its just for a little bit. I had to say the pledge back when I was in school and it is a tradition that will probobly continue.

The problem I have here, is that THE LAST PERSON TO STAND UP gets knocked down a few points. I do not think it is appropriate to have a race at the beginning of the day with your future on the line. Also, what happens if you just stand up and never sit down? If everyone did that could you somehow "cheat the system"?

i understand people are patiotic but its up to the individual whether to pledge allegiances to their country hasnt america got the right of free speech so isnt it your freedom not to salute

its a stupid thing to be complain for as there may be people from other countrys in the class and may feel strongly for their country

but if it was a case she just told you off it wouldt be so bad but to take off your grade is bad it seems shes not bothered wat is the schools policy on it?

[QUOTE="achilles614"][QUOTE="Vandalvideo"][QUOTE="Jandurin"][QUOTE="Vandalvideo"][QUOTE="Jandurin"]Shrug. The worst she can do is send you to the principal. Are you not standing because you just feel rebellious, or do you actually have some personal issue with the pledge?Guybrush_3

The worst she can do is absolutely nothing. I pointed this out on the first page of the thread, but West Virginia Board of Education v. Barnette.

She can send him to the principal. He can't do anything, but a teacher can send you to the principal for any reason.

Actually, if you took it to the courts you could argue the de facto segregation for an action protected by the constitution. That was another court case.... *fishes around in his law books* I can't find the specific case off the top of my head but teachers are not allowed to remove students from class for these types of things.

I didn't have her class today, but was talking with some friends on the issue. Apparently you don't have to pledge but you do have to stand up (for some reason) and signing the student code of conduct in the beginning of the year basically yields most of your rights (freedom of speech for example).

those student code of conduct has never held up in court.

yeah but I'm not going to court, if anything just the principal and in his office it does hold up.

The teacher isn't very popular amongst the students so I know if I don't stand up I won't be the only one. I'm not sure if I should just not stand up anymore, the whole idea of ****ing in your own yard comes to mind.

Teachers should teach, and when you're young, enforce a bit of discipline.

But a teacher should never enforce their social/philosophical/moral/religious beliefs on you.

It is so simple.

You're a minor, you can't sign legally binding contracts to begin with.

anyway if you look at your students rights and responsibilities handbook, you cant be forced to participate in any patriotic event slash activity, but you cant disrupt it (for example choosing that moment to take off your shirt and bootay shake to "im in love with a stripper on the speakers" of your pc)

Deducting points just because your the last person standing is the most childish way for an adult to discipline a student.

Yes but the emergency room did treat me without parental consent or even a valid medical card (actually it was my brothers) long story but anyways...you're parents sign it too, so I think it would hold up, I'm not really sure though what do you think?

I guess not standing would be considered "disruptive".

I think you guys completely missed the point...

The point is that its a race to stand up and its pretty dumb.

Thats all.
