Um, it's not my reality that there's a difference between women taking off their clothes and sexual assault. :|
I don't think you read that....:lol:
If the man leaves first, THEN he may not use force to defend himself (as it says in subsection bA); otherwise, yes, he can use force to defend himself against battery and assault.
This is the law. Plug your ears and keep repeating yourself all you want, but here's the state legislator saying quite explicitly that yes, he is allowed to use force.

Self defense laws in Texas:
(a) Except as provided in Subsection (b), a person is justified in using force against another when and to the degree he reasonably believes the force is immediately necessary to protect himself against the other's use or attempted use of unlawful force.
Okay, so force is allowed except in the following circumstances:
(b) The use of force against another is not justified:
(1) in response to verbal provocation alone;
As was not the case here.
(2) to resist an arrest or search that the actor knows is being made by a peace officer, or by a person acting in a peace officer's presence and at his direction, even though the arrest or search is unlawful, unless the resistance is justified under Subsection (c);
As was not the case here.
(3) if the actor consented to the exact force used or attempted by the other;
He did not consent to be bitten on.
(4) if the actor provoked the other's use or attempted use of unlawful force, unless
No.
(A) the actor abandons the encounter, or clearly communicates to the other his intent to do so reasonably believing he cannot safely abandon the encounter; and
Neither of which happened, making force justified.
(B) the other nevertheless continues or attempts to use unlawful force against the actor; or
Which is what happened.
(5) if the actor sought an explanation from or discussion with the other person concerning the actor's differences with the other person while the actor was:
(A) carrying a weapon in violation of Section 46.02; or
(B) possessing or transporting a weapon in violation of Section 46.05.
None of which occured.
(c) The use of force to resist an arrest or search is justified:
(1) if, before the actor offers any resistance, the peace officer (or person acting at his direction) uses or attempts to use greater force than necessary to make the arrest or search; and
(2) when and to the degree the actor reasonably believes the force is immediately necessary to protect himself against the peace officer's (or other person's) use or attempted use of greater force than necessary.
(d) The use of deadly force is not justified under this subchapter except as provided in Sections 9.32, 9.33, and 9.34.
There was no force to resist arrest.
So you see, it says exactly what I've been saying: the use of force is justified in cases of battery and theft of property.. It doesn't say a damn thing about your "you "HAVE to try to get away first" though.
Dude...you're still not getting it. Force is only allowed when it's obvious one cannot leave the area and a threat is imminent. Most of what you posted....albeit only accurate for the one state....was dealing with arrest and excessive force. Not applicable here to start with.No? Let's go over it again:

But if you are being attacked, and there is a way out you still have the right to defend yourself, as long as it's not excessively. But when it comes down to it, it's the law, and even something "clearly defined" is interpreted different by lawyers and judges and can be twisted and turned this way and that. Because even if there is a clear path to leave the person can just say they didn't realize there was an opportunity to leave the situation and that they felt they had no choice but to defend themself*.Internet: SERIOUS Business.Oh Snap.

If you can walk away then that is what the law expects. Excessive force as necessary means just that. You can of course, block someone from hitting you but you can't pound on him after he hits you. Well as you said, it differs from state to state, and either way it doesn't apply to this thread. But if someone hits you then you can retaliate, especially if it's necessary for you to be able to leave the situation. But yes, sadly if you do fight back you can also be charged with assualt, both parties have the option to press charges, then it's up to a judge to decide and have the final say on the situation. i'd agree with joshrock...the law is generally framed in such a way as to make it very difficult for a man to be the victim of sexual assault by a woman. In the UK (where I live) it's actually a legal impossibility for a man to be the victim of rape. Sure a guy can fight back if he feels he is the victim of sexual harassment, but he would then generally be either not believed with regards to the prior sexual assault, or arrested for assault & battery without mitigation. the fact is that social mores tell us that men simply can't be the victim of a sexual attack. you're free to disagree, but i would defy you to present evidence of sufficiently identical sex assault cases where a male victim is given the same credibility as a female one.
And I would tend to side with Theokoth too....you MAY be required to retreat, but teh duty to retreat is by and large confined to quite specific circumstances. If you have to use force while making said retreat, that will also be justified. By and large, reasonable use of force to protect yourself, others, or your property is accepted as an exculpatory defence at law for pretty much any crime. sure, it varies in the fine detail, but as a whole, around the world the judge/jury is required to look at the defendant's conduct and ask if it was reasonable in all the circumstances. if it was, its all kosher...

Yeah maybe that other site would be a better place to discuss why men should be allowed to beat women. haha niceI disagree with the assumptions here. First...sexual assault is hard to prove no matter which gender claims the assault. When it comes to the law in these cases the evidence has to be more than he said/she said or juries tend to not believe. Plus, the defense is allowed some leeway in discrediting the accuser. I think we all know sexual assaults occur. Some cases are justified. But many are not taken seriously. If one ever knew anyone attacked the attitude wouldn't be so cavaliar about this subject.i'd agree with joshrock...the law is generally framed in such a way as to make it very difficult for a man to be the victim of sexual assault by a woman. In the UK (where I live) it's actually a legal impossibility for a man to be the victim of rape. I don't think anyone thinks all women are angels, there are obviously exceptions to the rule. My point would be that society still views a man reacting violently to violence perpetrated upon him by a woman as total anathema....which is wrong. But I wouldn't go any further than that.
What... He's complaining? Maybe they were ugly. 0Tyler0According to the article the police said that from the tapes he seemed to be enjoying himself and the attention of the girls. IMO I think maybe he got mad they stole some of his CD's and instead of just accusing them of that tried to get them in even more serious trouble by claiming he was assualted as well. Although that's just what I gathered from reading the article, maybe he was willing at first but then they took it took far. Nobody would know for sure except those that were there and witnessed it. But either way the girls conduct was out of line and not acceptable for the workplace whether he was willing or not and they should be suspended or fired at the minimum.
No the law doesn't. It's treated the same. I think you are confusing societies comments with the law.Indeed...I think you're losing the plot somewhat here mate... I'm beginning to regret siding with you.
