Even though the 52-year-old mother of three attended her son's funeral -- she continues to ask how he's doing. When her family reminds her that he's dead -- she weeps as if hearing the news for the first time.

Shank suffered severe brain damage after a traffic accident nearly eight years ago that robbed her of much of her short-term memory and left her in a wheelchair and living in a nursing home.

It was the beginning of a series of battles -- both personal and legal -- that loomed for Shank and her family. One of their biggest was with Wal-Mart's health plan.

Eight years ago, Shank was stocking shelves for the retail giant and signed up for Wal-Mart's health and benefits plan.

Two years after the accident, Shank and her husband, Jim, were awarded about $1 million in a lawsuit against the trucking company involved in the crash. After legal fees were paid, $417,000 was placed in a trust to pay for Debbie Shank's long-term care.

Wal-Mart had paid out about $470,000 for Shank's medical expenses, but in 2005, Wal-Mart's health plan sued the Shanks for the same amount.

His husband makes a great point. Who needs the money more, a disabled person with three children, or a corporate company that netted over 90 billion dollars last year

which is why i say the president of walmart should just pull out acouple of millions out of his pocket and give it to her insted of taking it from the employes, he can afford it, they just dont want to pay

I think that people that work at Wal-Mart should start a fund-raiser or something. A tagline that said "Because Our Boss Won't" or something like that would be appropriate

Well that just goes to show the level of corporate greed. It's dispicable to have read that Wal-Marts attorney that is handling the matter says that the suit to recoup the $427k is so that all the people invloved in the health plan can benefit from recouping the money they awarded to her/them. I mean, I'm sure these people invloved in Wal-Marts health plan already have a good decent amount of money in their pockets. This $427k is a lot to you and me, but to a person/corporation that made $90 billion in one quarter, how much difference will it make to them? That's chump change to them if anything.
