To be fair, you're looking at higher resolution images and its not in motion, so you have time to absorb the lower res textures.Graphics could look abit better.

Correct, 3d or 2D, eye strain can make you see this effects, specially when focusing on such a small viewing area. Obviously, depending on your eye condition 3D effect can tire your eyes faster. Eye strain does not cause ghosting in 3D. Its called crosstalk and its normal for current 3D displays.
Ghosting happens when one image becomes more visible in both eyes, and may also be common in displays, but if you're eyes aren't capable of focusing on the screen properly, that is to say if your eyes are strained, ghosting can occur as a result. I had this problem with Pilotwings for nearly a week. Couldn't have the 3D all the way up as the ghosting effect was awful. Come the end of the week it was fine. I also get ghosting after lengthy periods of play, in which my eyes are straining to see the image clearly.Thanks for the tip. My scratches are permanent now. :| As far as I can recall I haven't had the system under any particular pressure. I'm not happy about it.
I'd say you were quite unlucky, but having read around it seems like this is the case with a number of people. A fair number of people have stated that it has been a result of carrying the 3DS in their pockets, which fits well with my story. The top screen really shouldn't be resting on the bottom half of the console when closed.
Does the top screen feel any looser than it did when you first bought it?
