No i am saying that games can have the same problem (e.g. Kane and Lynch 2 and CoD, not bashing them) and others may have it worse, e.g. New Super Mario Bro's is clearly too familar to previous games while Tomb Raider Underworld will offer a fresh expereience with new locations and gameplay mechanics. What i am trying to say is that the bolded games have suffered unfair criticism when the other games have the same issuses as compained about as mentioned in the reviews for the bolded games, anway this thread was made so others could list games that have unfair criticism.
But in most of those cases it's so that the games who didn't get an "unfair" review have many many many many stuff that overshines the weakspots and almost makes them hardly noticing them or they're just plain so good that it's worth to go through and they would be even better if they hadn't those, the ones you mentioned, well I can only speak for Splinter Cell because I played the first two games on PS2 and TRU because I own it:
About Splinter Cell, for games who're 10 years old and whilst most other HD Collection Titles work smooth and eprfectly fine you'd expect that it would run smooth, also in a Stealth Game where timing is critical important one Framerate could be the difference between a Stealth Kill and Alert Activated.
About TRU, it plays like Tomb Raider Legend, just darker, with less enemy variation and less revolutionary. Also the game design is plain bad, like the decision putting a complex underwarter level right at the start of the game. So the game starts really slow and drags along, and in the ACTION Adventure Genre having a slow start is a big mistake in my opinion.
The Splinter Cell 'famerate issues' are largley over-exaggerated and are just hiccups that last about a second, if that.
As for Tomb Raider underworld, sure it has similar gameplay to Legend (well DUH, it's part of the same series), and of course it's darker (hence the same Underworld), the game was made to have more platforming this time around and was designed for those who had played the previous two games so the would have not struggled with the underwater level.
