@Iconoclysm: If the NDA was simply there and unsigned, it's not really binding (there are some contractual oddities where an unsigned agreement can be binding, but this doesn't seem likely here). But you are undoubtedly right that the device would be pretty much useless anyways. My original point was only that a MS employee would have severe legal liability if he sold or disclosed something, as would Sony if it purchased it from the MS employee. From a random person with no NDA, though, that's a different story.

@Barighm: This is true. I think they could potentially get their equipment back, as companies have been able to do in the past (although admittedly, I don't know the law on that AT ALL, so maybe not), but he wouldn't be under any obligations to keep quiet or anything.

@Iconoclysm: A Microsoft employee would be in legal trouble if he did so, though, as would Sony. Undoubtedly their workers have NDAs and other employment agreements, and if Sony helped (even by merely purchasing the unit) one break an agreement, Sony would be liable for tortious interference with contract.

@romeothebeast: Even if merged, they'd be cutting off half their revenue and they really wouldn't be able to keep their console game developers on payroll for that time frame. And sure, there are plenty of ways they can make money, but those are revenue streams they already have access to. They'd just be sacrificing one of their biggest revenue streams for no good reason. If they sit a console cycle out entirely, they'll never get back in. Look at Sega. They botched the Saturn badly and sat out that generation as a result. They tried coming back with the Dreamcast like 4 years later and despite the fact the it was released years ahead of any other 128-bit system and had tons of great first party games, as well as the first console with built-in internet connectability and many other innovations, it didn't last long. Nintendo knows they can't get out of the console market until they're ready to exit it for good.

It's possible the PS4 and Xbox 1 won't last a decade. But I don't see them ending before a total 5 year run, minimum. And if the rumors are true about upgrades, it signals the end of console generations, as you'd just buy an upgraded version every couple years (similar to PC gaming) that could play your old PS4 or XB1 games as well as the newer ones at higher settings. Microsoft has already said that's their goal, so if Nintendo jumps ship now, they'll effectively be fighting to get back in this same generation in 5 years but with a fraction of the game catalog their rivals have built up.

But I agree on price point. Nintendo has to sell at a large loss if they want to get into the market truly. Especially considering their hardware is so inferior and game selection is weak. Nintendo's biggest problem is they refuse to discount games and hardware pretty much at all. I have a Wii U, but have about 5 games, because several year old games are still full price for the most part.
