Microsoft is facing a possible class action lawsuit from Xbox 360 users aggrieved at being banned for piracy, alleging that the company intentionally timed its bans to coincide with the release of popular games, and deliberately took advantage of the fact it was not refunding unused subscription time.

Abington Law rubs its hands with glee at the prospect of a profitable class action suit:

As has been reported widely in the media, tens of thousands of Xbox owners have had their modified Xbox consoles banned from Microsoft's online gaming service Xbox Live.

Although modification of Xbox consoles is *arguably* against the terms of use for Xbox/Xbox Live, Microsoft "conveniently" timed the Xbox console ban to coincide with the release of the new Call of Duty: Modern Warfare 2 game and less than two months after the release of the very popular Halo 3: ODST game.

This "convenient" timing may have resulted in more Xbox Live subscription revenues for Microsoft than it would have generated had these Xbox console bans taken place at some time before the release of Halo 3: ODST and Call of Duty: Modern Warfare 2.

Additionally, sales of both Call of Duty: Modern Warfare 2 (published by Activision) and Halo 3: ODST (published by Microsoft Game Studios) would likely have been greatly diminished had the Xbox console ban occurred prior to the release of these games.

Additional *reported* problems resulting from the bans include, but are not necessarily limited to:

* Disabling/altering Xbox functionality *NOT* associated with Xbox Live or piracy (HDD functionality for example);

* Disabling/altering Xbox functionality *NOT* associated with piracy (Netflix, game add-ons, music, and arcade games for example);

* Obtaining information from Xbox consoles without permission of the owner;

* Other problems/consequences associated with these bans have been reported here and elsewhere.

As an aside, PIRACY IS A LEGITIMATE CONCERN for Microsoft and other content producers. HOWEVER, (to use a poor analogy) Microsoft has chosen to use one of the most indiscriminate "weapons" in its arsenal in an effort to combat piracy — as a result, use of this "weapon" has resulted in a great deal of collateral damage — many people were affected who had nothing to do with piracy.

Furthermore, Xbox console functions that have nothing to do with piracy were also affected or disabled.

Details aside, Microsoft's bans could (and should) have been more measured.

Notably, the lawsuit is explicitly on behalf of Xbox Live users who had their "modified Xbox console" banned, meaning that the issue of them violating their usage agreement with Microsoft is not in doubt.

Undoubtedly a self-serving venture for the lawyers concerned, but with millions of dollars tied up in the timing of the bans it is far from ridiculous to suggest Microsoft may have taken such factors into account – indeed, it would have been rather sloppy had they not done so.

Just whether they will succeed in getting anything out of Microsoft is another matter however, though with hundreds of thousands of angry pirates and a supposedly substantial number of accounts banned in error there will likely be no shortage of people eager to see them pay for having the gall to try to make users pay for their software…

Anyone who uses a regular HDD instead of the overpriced 100$ HDD's microsoft wants to milk you with is a likely target for theyr wrath.

If you chip your xbox and then continue to play online you are pretty dumb, its obvious they are going to detect you and ban you. People saying 'I just chipped is so I could use another hard-drive, I'd never play a copied game' are being disingenuous to say the least.

I got my old Xbox banned, but oh well I learned my lesson and went legit, these people need to accept the consequences of their actions and realize what they did was wrong, what I did was wrong I accepted the consequences bought a new Xbox and refuse to mod again.

Hey, if you're going to ban a million users, at least do it AFTER your IPs are well out the door :P. Then slap on the ban right when another awesome game comes out to really stick it to 'em! I have no problem with Microsoft cracking down at a time like that, TBH. Sure it's a little dirty, but so is "modifying" your console to enable pirated games (which in turn bites honest people like me in the ass in the long run :evil: ).

Technically it is. You violate the EULA by modifying your console. Which means MS is totally within their rights to ban you.

This is untrue, and an awful lot of people who got banned are suddenly claiming this is all they did. You cannot just 'replace' the HDD. It's a proprietary device made just for the 360. In order to use another one, you need to make significant modifications to the console. And once again, an awful lot of these modded HDDs have terabites of storage for storing.... guess what? Pirated games. If someone did genuinely go to all the trouble of modding their 360 just so they could use their own HDD, i guess that sucks for them. But if they're savvy enough to do that they must surely be aware of the fact that you're not supposed to do it. After all, xbox live does remind you plenty of times that any mods to the console at all = xbox live ban. It's only fair.

MS can ban whenever they want, but if someone wants to waste money on a lawsuit let them. Poor pirates. :roll: They can still play pirated games, they just can't install, use windows media, or play on XBL.

None of this matters because they shouldn't have been hacking their system to begin with. It's a clear violation of the TOS and Microsoft has every right to do what they did. It's all spelled out in the TOS that YOU AGREE TO. The hacked systems should just be glad they got away with playing free games for as long as they did. I have no pity for them. Nor will this lawsuit matter, there is no case.

They are not modding the drive, they are modding the cooling hardware. I'm just saying that maybe some people modding it to use generic HDs didn't actually plan to pirate but just wanted a cheaper HD option than to get milked with the propietary HD sold by M$.

They are not modding the drive, they are modding the cooling hardware. I'm just saying that maybe some people modding it to use generic HDs didn't actually plan to pirate but just wanted a cheaper HD option than to get milked with the propietary HD sold by M$.

MS isn't looking for people that mod their coolers. They can't even tell who's done so. They're looking for people that have modified their DVD drive. And they can tell who's done so.

This is like buying a new car that gets a certain MPG and hacking into the electronics to chip it and get better efficiency. It still voids the warranty because you're agreeing to use it in a closed, manageable system. People know the price of HDDs for the 360 before they bought one. Suddenly AFTER you making your purchase you feel entitled to a cheaper option? I feel I should be paid more per hour. Do I steal office supplies because I feel entitled? The world doesn't work that way son.

Who knows how true that is? You have to question it, unless you're a fanboy, then you'll believe anything. MS has a way to detect a modified DVD drive. MS isn't going to ban someone that hasn't modified it. When people are caught doing stuff like this, they'll make any, and every excuse in the book, and blame MS for what THEY, themselves, did.

It voids the warranty but they don't destroy your car.

Banned 360's can still play 360 games. You should not have access to any feature that requires XBL silver or gold. Also you shouldn't be allowed to store games to the HDD for obvious reasons.

As has been reported widely in the media, tens of thousands of Xbox owners have had their modified Xbox consoles banned from Microsoft's online gaming service Xbox Live.

Although modification of Xbox consoles is *arguably* against the terms of use for Xbox/Xbox Live, Microsoft "conveniently" timed the Xbox console ban to coincide with the release of the new Call of Duty: Modern Warfare 2 game and less than two months after the release of the very popular Halo 3: ODST game.

This "convenient" timing may have resulted in more Xbox Live subscription revenues for Microsoft than it would have generated had these Xbox console bans taken place at some time before the release of Halo 3: ODST and Call of Duty: Modern Warfare 2.

Additionally, sales of both Call of Duty: Modern Warfare 2 (published by Activision) and Halo 3: ODST (published by Microsoft Game Studios) would likely have been greatly diminished had the Xbox console ban occurred prior to the release of these games.

Additional *reported* problems resulting from the bans include, but are not necessarily limited to:

* Disabling/altering Xbox functionality *NOT* associated with Xbox Live or piracy (HDD functionality for example);

* Disabling/altering Xbox functionality *NOT* associated with piracy (Netflix, game add-ons, music, and arcade games for example);

* Obtaining information from Xbox consoles without permission of the owner;

* Other problems/consequences associated with these bans have been reported here and elsewhere.

As an aside, PIRACY IS A LEGITIMATE CONCERN for Microsoft and other content producers. HOWEVER, (to use a poor analogy) Microsoft has chosen to use one of the most indiscriminate "weapons" in its arsenal in an effort to combat piracy — as a result, use of this "weapon" has resulted in a great deal of collateral damage — many people were affected who had nothing to do with piracy.

Furthermore, Xbox console functions that have nothing to do with piracy were also affected or disabled.

Details aside, Microsoft's bans could (and should) have been more measured.

Notably, the lawsuit is explicitly on behalf of Xbox Live users who had their "modified Xbox console" banned, meaning that the issue of them violating their usage agreement with Microsoft is not in doubt.

Undoubtedly a self-serving venture for the lawyers concerned, but with millions of dollars tied up in the timing of the bans it is far from ridiculous to suggest Microsoft may have taken such factors into account – indeed, it would have been rather sloppy had they not done so.

Just whether they will succeed in getting anything out of Microsoft is another matter however, though with hundreds of thousands of angry pirates and a supposedly substantial number of accounts banned in error there will likely be no shortage of people eager to see them pay for having the gall to try to make users pay for their software…

Mod chips and the like are illegal, and have been under scrutiny by Customs for several years now. Going into a courtroom to sue MS because you got banned for modding your console would be like going into a courtroom to sue someone because they stole your illegal drugs.

And the people that allegedly modded their console just so they could get a cheaper HDD? MS only allows officially licensed add-ons. If they wanted a console that allows you to use any brand of add-on, there is one they could have bought instead. Oh, wait, it's too hard to pirate games on PS3, so that wouldn't have worked for them...

Who knows how true that is? You have to question it, unless you're a fanboy, then you'll believe anything. MS has a way to detect a modified DVD drive. MS isn't going to ban someone that hasn't modified it. When people are caught doing stuff like this, they'll make any, and every excuse in the book, and blame MS for what THEY, themselves, did.

Dude, MS isn't going to ban some one for no reason. Just because you have some delusional hate for MS, doesn't mean they are truly "evil".

People that modify their consoles to play pirated games aren't exactly the most honest people to begin with, obviously. So, of course they're going to make up some story, and blame everyone else.

The thing is that M$ probably made mistakes when banning many people. I'm not going to trust M$ more than I trust a random guy on the internet. Both random guys and M$ have lied plenty for me to trust any of them but M$ has done much more to lie or to say half-truths than any other comapny I know (although all of them do it obviously) so no, I don't just trust them.

This is stupid. It says in the TOS and MS has stated many, many times if you mod your Xbox to play pirated games, your console will be banned from XBL. Not your gamertag, your CONSOLE. Also how many times is this going to be posted?

They wont have to, all they have to admit to is replacing the HDD.

Replacing the HDD already results in a ban? Who would want such a rule? That is ridiculous.

For tampering, currently people with flashed HDDs are changing the gun stats on borderlands and duping them.
